A decision which will have significant implications for notorious killer Graham Dwyer's bid to overturn his murder conviction and criminal investigations generally will be delivered today by the Supreme Court.
Seven judges have been considering an appeal by the State against a December 2018 High Court ruling that legislation used by gardaí to access Dwyer's communications data contravened EU law and an international human rights convention.
If I remember and there is a thread here somewhere I always thought the evidence was weak and he would get off even though he probably did it .If the Judge rules against the Phone he walks and so do others ?

Supreme Court Judgement going to be Live on TV tells you how important this issue is .If they rule the gards broke the law then other cases where phone evidence was used illegally could mean new trials or acquittals .Our Minister for Justice Charlie Black and Tan Flanagan .You know him the one that just disappeared from View will have to come out of hiding to say something or say nothing after the Judges are finished .

From my understanding of the Judgement just given .The Court say the Judge who said it was illegal said so after the Case and the Supreme Court say that he might be right but might not be and if he is right then it only applies to cases After he made the Judgement not before it .They are sending their Judgement to Brussells for clarification .One Judge dissagreed and said Ireland has certain rights to opt out and its none of the ECJs business .

No from my reading of it .The Supreme court are not sure and are sending the Question to the ECJ but the Irish Supreme Court says the appeals court judgement might only apply to issues after it was made and not before it sort on not retrospectively applicable .It will depend on how the ECJ rules and that might take years .

Life only means until a judge releases you so instead of allowing a challenge to go to court and succeed there might be some fetteling and tweeking .Most murderers get out in the end .

One of the Judgements gave the Gards a hard kick in the Mickey .The Supreme Court said if the Gards want to search your data they must get INDEPENDENT permission .So a Garda asking his superintendent for permission is not Independent as both of them are members of the Garda Sports and Social Club and Credit Union .

I recall an experience I had one saturday night on blunden drive rat.I was driving along it ,when suddenly my whole windscreen shattered in front of me.I must admit I got a hell of a fright.the scumbags were throwing bricks over the wall at passing cars,and they scored a direct hit in my case.when I got out to look,this little prick appeared from nowhere big fukkin smirk on his ugly mush .he knew I could do nothing,because I couldnt prove he was involved.I went to coolock Garda station and reported it.the only answer I got from a female Garda was,you obviously dont drive through coolock to often do you ? That was the end of the matter as far as she was concerned

It seems to be popular with roaming gangs of teenagers at the weekends. I've noticed several times groups of twenty, thirty or more... probably up to no good. However, I've never experienced a missile attack there myself. It's not uncommon for youths the throw or fire things at cars (maybe directed mainly at taxis?) in the northside suburbs. I've experienced quite a few myself over the years with a shopping trolly launched off Shantall Bridge into my path on the M! being the most serious. I've had the roof sign smashed too, again in Santry and an egg and other missiles on Oscar Traynor Road, Priorswood Road and up by the patch in Darndale.... and then we have the likes of NTA wanting our cars in pristine condition for the multitude of tests... while our hearts and lungs can be completely bollixed!

Oh, when I reported the shopping trolley - the only one I've ever reported because it done quite a bit of damage - the Gradai went down to find out who owned it and suggested I contact Tesco for compensation. I didn't bother in the end, just got the bits in a scrapyard and the father-in-law painted them with a couple of tins from Vinny Byrnes... but I wonder if I would have got anywhere?

No point of law was examined when a Mr o'Ne... (can't publish full name) was knifed 21 times, and had been wise enough to denote previous incidents..events even recorded by Tallaght hospital and accepted into evidence in the initial trial......she walked despite the preponderance of case evidence against her...You have no idea how powerful this Feminist 4th Wave movement is, John. I hope you never have to find out. The only woman any Irish man should hook up with nowadays is a foreigner.........they're not quiet as deranged as those from our shores yet....it is legal to murder a man and walk away in this country....I have over 10 cases I could refer to...some of which are not very recent. The appeal in this case has more to do with others walking than the named perp.............the evidence against him is very, very watery.
