TWO mothers arrested at Dublin Airport for refusing to go to a quarantine hotel after returning from a cosmetic surgery trip to Dubai have been held in custody on strict bail.
Mother-of-two Kirstie McGrath (30) with an address at St Anthony’s Road, Dublin 8 and Niamh Mulreany (25) a mum of one from Scarlett Row, Essex Street West, Dublin 2 were arrested on Friday afternoon at Terminal 2 after coming back from the United Arab Emirates (UAE).
Defence forces personnel called gardai who brought them to Ballymun garda station and charged them with breaking the Health Act. They deny the charges and appeared before Judge Miriam Walsh at Tallaght District Court on Saturday.
The judge noted the two friends had gone away for breast enhancement surgery and she questioned if that was essential travel.
“Colloquially referred to as a boob job”, she later described their medical procedures as the reasons for their trip emerged. The court heard gardai spent almost two hours trying explain the regulations to the women who claimed they did not know about the law change.
They pleaded for bail with their solicitor Michael French citing humanitarian grounds. He said they had children to care for and were not aware of the regulations. They had also provided three negative covid tests in the last week and could quarantine at home, he argued.
He also said they will contest the charges and contended that it was a relatively minor offence with serious ramifications.
A challenge to the constitutionality of the law will be taken, he said. He submitted that people with Covid-19 were allowed quarantine at home and were not subject to the same restrictions as the hotel quarantine measures travellers faced.
He submitted that they did not have the funds for the quarantine fees and that refusal of bail was disproportionate for an offence which carries a one-month jail term.
Judge Walsh granted bail with conditions but it requires independent sureties to freeze bank accounts.
This means, the defence argued, that they will not be able to take up the bail until Tuesday when banks are open again.
Gardai were alerted on Friday afternoon by the State Liaison officer after the two friends flew in from the UAE and allegedly refused to agree to comply with go to a quarantine hotel.
A payment of the €2,500 fee for their accommodation was also sought, the court heard.
Breaking new 14-day hotel quarantine law for travellers arriving in the State can result in a €2,000 fine and a sentence of up to one-month in jail.
The measure was introduced to prevent the spread of coronavirus and is mandatory for people arriving from 58 states or if they have not had a negative Covid test taken within 72 hours.
The two women appeared separately before Judge Walsh.
Garda Inspector Luke Lacey, of Dublin Airport Garda station, said there were objections to bail due to their failure to comply with the statutory travel regulations introduced to avoid the spread of the disease.
Releasing them would make a “mockery of the Act”, he argued. He told the court that “extraordinary times required extraordinary measures”.
Distraught Kirstie McGrath was called in first. She wept throughout the hearing and at times shielded her face from the public gallery.
Garda Robbie Barber told Judge Walsh that Ms McGrath made no reply to charge.
He arrested her at 2.50pm, after he spent one hour and 50 minutes outlining the rules and giving her an opportunity to make phone calls for advice, he said.
“It was explained in ordinary language what would happen if she did not go to the quarantine hotel,” Garda Barber said.
She was also told state liaison officers would be at the hotel to explain the process but she refused to go, it was alleged.
Mr French said the rules were an erosion of his client’s constitutionality. She was entitled to bail and like her friend had no warrant history, and would comply with conditions at home, he submitted.
He explained that Ms McGrath had gone once to Dubai for cosmetic surgery but his client did not want to say it in open court.
A note was handed in and the judge read it and said it was for the purpose of breast enhancement, adding, “that is essential travel?”
Garda Karl Connor told the court that Niamh Mulreany also made no reply to charge. It was alleged he spent one hour and 45 minutes explaining the terms and he was also given a chance to get advice.
Mr French said that Ms Mulreany was on the lone parent’s allowance and needed to care for her child. Exceptions to the regulations are allowed and she could abide by conditions and remain in her home, he suggested.
He told the court that like her co-accused, Ms Mulreany had three negative Covid tests in the last week, one in Dublin before she flying out to the UAE and twice before she returned.
Judge Walsh noted Ms Mulreany had also gone for breast enhancement or modification surgery.
Both were supported by family members in the public gallery.
The two women did not address the court.
A pandemic was raging around the world and laws have been enacted which must be complied with, the judge warned.
She set identical bail terms in each case.
They were remanded on their own bonds of €800 each and they must lodge €500 cash. The judge also required independent sureties to be approved in each case, set at €2,000 of which €1,800 must be lodged and €200 has to be frozen in their bank accounts.
The defendants must surrender passports with immediate effect. Once the bail money is organised they can be released and must remain at government allocated hotels for 14 days unless they provide a negative PCR test after 10 days.
The two women must remain contactable by phone and not leave the jurisdiction except for essential travel. The cases will resume on April 9 next at Dublin District Court.
Legal aid was granted.

The High Court has directed an inquiry into the detention of two mothers who refused to enter mandatory hotel quarantine after arriving into Dublin Airport following their return from a trip to Dubai.
On Easter Sunday Mr Justice Paul Burns directed the inquiry, under Article 40.4.2 of the constitution, the legality of the detention of friends Niamh Mulreany and Kirstie McGrath at Mountjoy woman's prison.
The inquiry has been directed against the Governor of the prison, where the two are currently being held.
Both women were arrested and charged with breaching Section 38 of the Health (Amendment) Act 2021 by refusing to be detained in quarantine following their alleged refusal to go the designated hotel on Friday.
Those found guilty of the offence could face maximum sentence of one month in jail and or a fine of 2000.
The court heard that they had travelled to the UAE, where they were due - but ultimately did not undergo -cosmetic procedures.
The court also heard that the trips and procedures were birthday presents funded by the women's respective families and friends.
The pair were granted bail by the District Court on Saturday, on terms including that they remain in the hotel, and that they provide their own bond of €800, of which €500 must be lodged.
They must also provide an independent surety of €2000, €1800 must be lodged. They were also to reside at the designated hotel, surrender their passports and not leave the jurisdiction.
However, the High Court heard that neither woman was able to take up bail resulting in their detention at the prison.
At the High Court John Fitzgerald SC, appearing with Keith Spencer Bl, instructed by solicitor Michael French for the two women said that their detention is not lawful and have sought an inquiry aimed at securing their release.
Counsel said that the focus of the inquiry relates to his clients' dissatisfaction with the bail hearing and the "draconian and disproportionate" conditions imposed on them by the district court.
Counsel said that the bail conditions were imposed on two persons with no previous convictions, where no inquiry into their means was made, and who had tested negative for Covid19 following three recent tests.
The state's objections to bail arouse out of concerns over the covid19 pandemic and not for any of the usual grounds, counsel said.

The mandatory quarantine, which his clients were not aware of before they left for Dubai, amount to a form of preventative detention which he said has no lawful basis.
The amount sought to be lodged as part of the bail conditions were beyond his clients' means, counsel said adding that Ireland "had abolished debtors' prisons" some time ago.
Counsel said that the bail conditions were onerous and made no sense given they could not afford the cost of the hotel.
Out of concern for their children his clients had offered to isolate at their own homes, rather than at the hotel, but this offer was not accepted.
In reply to the judge counsel accepted that a constitutional challenge may be brought against the provisions in the Health Act under which his two clients were charged.
Counsel said Ms McGrath of St Anthony's Road, Rialto Dublin 7 is the mother of children aged 10 and 8 years, and is the recipient of lone parents' allowance.
Her trip to Dubai was a 30th birthday present funded by family and friends.
She was due to undergo a cosmetic medical procedure, which she believed would assist her in addressing some personal matters
Counsel said that Ms McGrath's mother, who has taken leave from her job, has been looking after her two children. However, her mother must return to work in the coming days.
Mother of one Niamh Mulreany, who also celebrated her 25th birthday in March, also had her trip funded by a family member as a gift.
Ms Mulreany of Scarlett Row, Essex Street West, Dublin 2, who previously had breast enhancement surgery. had travelled with the intention of undergoing a corrective procedure carried out in Dubai.
She too did not go ahead with the procedure. She is also in receipt of the lone parent allowance.
Counsel said that when they attempted to return to Ireland from Dubai on March 31st last, they were informed that she must pay €1,850 in order to quarantine at a hotel upon arrival in Dublin.
They were not able to pay that sum, and was told in Dubai that if they did not pre-book the hotel and pay, she would be denied passage to Dublin.
They were not allowed board flights to Dublin for two days. Following presentations from a public representative and the Irish consulate UAE after they agreed to make deferred payments for the hotel.
They had also believed that their children could stay with them in the hotel. However, when they returned to Ireland, they were told they would have to pay the fee and that their children could not stay with them.
Arising out of that they refused to travel to the designated hotel because they could not afford the fee, and over concerns for their children.
Counsel said that neither were aware of the new quarantining requirements before they departed to Dubai.
The inquiry into their detention has been made returnable to later this afternoon.

Mr French said the rules were an erosion of his client’s constitutionality. She was entitled to bail and like her friend had no warrant history, and would comply with conditions at home, he submitted.
He explained that Ms McGrath had gone once to Dubai for cosmetic surgery but his client did not want to say it in open court.
A note was handed in and the judge read it and said it was for the purpose of breast enhancement, adding, “that is essential travel?”
Garda Karl Connor told the court that Niamh Mulreany also made no reply to charge. It was alleged he spent one hour and 45 minutes explaining the terms and he was also given a chance to get advice.
Mr French said that Ms Mulreany was on the lone parent’s allowance and needed to care for her child. Exceptions to the regulations are allowed and she could abide by conditions and remain in her home, he suggested.
He told the court that like her co-accused, Ms Mulreany had three negative Covid tests in the last week, one in Dublin before she flying out to the UAE and twice before she returned.
Judge Walsh noted Ms Mulreany had also gone for breast enhancement or modification surgery.
Both were supported by family members in the public gallery.
The two women did not address the court.
A pandemic was raging around the world and laws have been enacted which must be complied with, the judge warned.
She set identical bail terms in each case.
They were remanded on their own bonds of €800 each and they must lodge €500 cash. The judge also required independent sureties to be approved in each case, set at €2,000 of which €1,800 must be lodged and €200 has to be frozen in their bank accounts.
The defendants must surrender passports with immediate effect. Once the bail money is organised they can be released and must remain at government allocated hotels for 14 days unless they provide a negative PCR test after 10 days.
The two women must remain contactable by phone and not leave the jurisdiction except for essential travel. The cases will resume on April 9 next at Dublin District Court.
Legal aid was granted.

We Irish choose to loosely interpret it by reducing to normal forty-day quarantine to fourteen. We then dilute it further to say if the patients show no signs after a mere ten days, they might be safe to enter the community.

HERE IS MORE BOLLOX from todays MIRROR ...Several gardai have been told to self-isolate tonight as it emerged that the now infamous ‘Dubai-two’ are caught up in a Covid-19 scare.
It is understood at least six gardai have been told to self-isolate at home after coming into close contact with a confirmed case of Covid-19.
Niamh Mulreany and her pal Kirstie McGrath, who allegedly refused to enter into mandatory hotel quarantine after arriving into Dublin Airport from Dubai, are also caught up in the Covid-19 scare.
It’s understood that Kirstie McGrath, 30, tested positive for Covid-19 and Niamh Mulreany, 25, is being treated as a close contact.
The women's solicitor declined to comment last night.
Whats the Story with all the Women in the Ladys section of the Joy are they all self isolating in single sells and are they entitled to compo as the infected persons were imported into their Prison possibly without a Covid test .I thought these Girls had had covid tests before they flew if so and they were clear then the tests are unreliable or this girl has caught the Covid off of a Garda while in Detention or in Prison while in detention .

The mother of one of two friends who were ordered into quarantine after a trip to Dubai claimed they were both being refused access to independent Covid-19 testing.
Niamh Mulreany's mother Sabrina also said the women were 'being treated worse than animals’ and the whole situaton had become ‘a circus’.
Ms Mulreany (25) and Kirstie McGrath (30) allegedly refused to enter into mandatory hotel quarantine and were subsequently arrested for breaches to the Health Act last Friday.
Ms McGrath since received a positive PCR test result which has resulted in several gardai being told to self-isolate. However it is understood that a subsequent test result has been received which is negative.
Ms Mulreany’s mother, speaking on behalf of the friends, has confirmed that both girls received a Covid-19 PCR test, after testing negative to a previous three, and an antibody exam, when they entered the women’s prison on Saturday night
They had asked authorities, Department of Health, for independent PCR tests to be carried out on the girls on Monday evening.
She said a GP was to be allowed to enter the hotel at 7.30am on Tuesday. However, at 1.11am on Tuesday legal representatives were told that this had been stopped.
In correspondence from the quarantine hotel where the friends are staying, the girl’s parents were told, “access to the mandatory quarantine facility is not approved”.
The letter adds: “The HSE as the person approved by the Minister for Health to conduct RT-PCR tests with the applicable travellers in designated facilities under section 38 of the Health Act. The Minister has not designated or approved any person other than the HSE to conduct RT-PCR tests.
“There is no entitlement accruing to persons in quarantine to have RT-PCR tests conducted by anyone other than the HSE. In the circumstance the Department of Health cannot agree to the facilitation of a privately sourced PCR test.”
In response, Ms Mulreany’s mother, who is a frontline worker said: “Niamh and Kirstie are being made examples of it’s as simple as that and the question has to be asked why?
"When those girls got onto the plane in Dubai they did not have Covid-19. The girls left Ireland on the morning of March 24 and the new rules on quarantining did not come in until March 26, two days later so why is this happening?
“These two girls are not statistics and what is happening is having an awful affect on them.”
Ms Mulreany added that the friends “are being treated worse than animals - this is a complete circus.
“The girls have done nothing wrong. They didn’t break any rules and followed all guidance. Why are they being made examples of and why not those who gave vaccines to people who were not yet entitled to them?
“They checked with the airline they were travelling to Dubai with and Government authorities as to what guidelines they had to follow. They were told they were allowed to travel as long as they had negative PCR tests and medical documentation explaining why they were leaving the country. They followed all the guidelines they were told to do.
“They were kept in awful conditions in prison and left in a garda van for almost four hours in the heat prior to their court appearance on Saturday as they could not enter the court house due to Covid-19 restrictions. Both girls are suffering psychologically as we all are.”
The arrest of the two women and subsequent court action has now resulted into a constitutional challenge against laws requiring persons to enter mandatory quarantine on their arrival into Ireland from certain countries.
The pair appeared at Tallaght District Court and were granted bail but remained in custody and detained at the Dochas women’s prison as they could not access financial funds needed for bonds and sureties.
The High Court on Sunday made orders allowing mother-of-one Ms Mulreany and mother-of-two Ms McGrath to leave prison.
Mr Justice Paul Burns amended bail conditions imposed on the friends enabling them to leave prison and continue to quarantine at a designated hotel.
The judge also declined the women’s application to be allowed quarantine at their respective homes instead of the hotel so they could be re-united with their children.

The letter adds: “The HSE as the person approved by the Minister for Health to conduct RT-PCR tests with the applicable travellers in designated facilities under section 38 of the Health Act. The Minister has not designated or approved any person other than the HSE to conduct RT-PCR tests.
“There is no entitlement accruing to persons in quarantine to have RT-PCR tests conducted by anyone other than the HSE. In the circumstance the Department of Health cannot agree to the facilitation of a privately sourced PCR test.”
In response, Ms Mulreany’s mother, who is a frontline worker said: “Niamh and Kirstie are being made examples of it’s as simple as that and the question has to be asked why?
"When those girls got onto the plane in Dubai they did not have Covid-19. The girls left Ireland on the morning of March 24 and the new rules on quarantining did not come in until March 26, two days later so why is this happening?
“These two girls are not statistics and what is happening is having an awful affect on them.”
Ms Mulreany added that the friends “are being treated worse than animals - this is a complete circus.
“The girls have done nothing wrong. They didn’t break any rules and followed all guidance. Why are they being made examples of and why not those who gave vaccines to people who were not yet entitled to them?
“They checked with the airline they were travelling to Dubai with and Government authorities as to what guidelines they had to follow. They were told they were allowed to travel as long as they had negative PCR tests and medical documentation explaining why they were leaving the country. They followed all the guidelines they were told to do.
“They were kept in awful conditions in prison and left in a garda van for almost four hours in the heat prior to their court appearance on Saturday as they could not enter the court house due to Covid-19 restrictions. Both girls are suffering psychologically as we all are.”
The arrest of the two women and subsequent court action has now resulted into a constitutional challenge against laws requiring persons to enter mandatory quarantine on their arrival into Ireland from certain countries.
The pair appeared at Tallaght District Court and were granted bail but remained in custody and detained at the Dochas women’s prison as they could not access financial funds needed for bonds and sureties.
The High Court on Sunday made orders allowing mother-of-one Ms Mulreany and mother-of-two Ms McGrath to leave prison.
Mr Justice Paul Burns amended bail conditions imposed on the friends enabling them to leave prison and continue to quarantine at a designated hotel.
The judge also declined the women’s application to be allowed quarantine at their respective homes instead of the hotel so they could be re-united with their children.

A FORMER FAS worker with St Vincent de Paul told a judge she had put on an extra five stone in weight since suffering a lower back injury in one of the charity's shops.
"I was just 12-and-a-half stone when the accident happened and I'm now over 17 stone. My body is very embarrassing," Sabrina Mulreany, of Braithwaite Street, Pimlico, Dublin, said in the Circuit Civil Court.
She said she was in constant pain and had to give up many of her original activities.
Mulreany, who told barrister Shane English she tripped over a plastic baby walker in Vincent's Charity Shop in Clondalkin, Dublin, in February 2008, lost a €38,000 damages claim for personal injuries against the charity and FAS.
She claimed the baby walker had been concealed beneath a rail of coats in the charity shop where she had been placed as a community worker by the national training and employment authority.
Fear
Mulreany told Mr. English, counsel for FAS and the charity, she had refused to go to the hospital in an ambulance on the day of her fall because of a "horrible" fear she had of doctors.
"I would have to be on death's door before going," she said.

She told the court her partner, Eddie Freeman, had called to the shop to drive her home and only after a week of constant low back pain and pressure from Eddie did she agree to go to her GP, Dr Alan O'Donohoe.
Mulreany told Mr English she attended Dr O'Donohoe on only four occasions since 2008 and had not acted on advice to have physiotherapy and an MRI scan.
Judge Deery, dismissing her €38,000 claim with an order for defence costs, said Ms Mulreany had claimed the baby walker was concealed entirely under a rail of coats and, if so, she had no reason to walk into it.
It seemed she was the author of her own misfortune and her complaints as outlined in court might not have their origin in the fall in the shop. He said her claim was not well-founded.

The issue is simpler. If you have enough money to travel outside the national 5KM limit, and the trip is essential, plus you are Covid free then you can travel, providing you agree to quarantine on your return.
I'm going to hazard a guess that a certain person and extended members of the family will lodge a compensation claim. Having gained circa FIVE stone, what with all the worry and all.

TWO mothers arrested at Dublin Airport for refusing to go to a quarantine hotel after returning from a cosmetic surgery trip to Dubai have been held in custody on strict bail.
Mother-of-two Kirstie McGrath (30) with an address at St Anthony’s Road, Dublin 8 and Niamh Mulreany (25) a mum of one from Scarlett Row, Essex Street West, Dublin 2 were arrested on Friday afternoon at Terminal 2 after coming back from the United Arab Emirates (UAE).
Defence forces personnel called gardai who brought them to Ballymun garda station and charged them with breaking the Health Act. They deny the charges and appeared before Judge Miriam Walsh at Tallaght District Court on Saturday.
The judge noted the two friends had gone away for breast enhancement surgery and she questioned if that was essential travel.
“Colloquially referred to as a boob job”, she later described their medical procedures as the reasons for their trip emerged. The court heard gardai spent almost two hours trying explain the regulations to the women who claimed they did not know about the law change.
They pleaded for bail with their solicitor Michael French citing humanitarian grounds. He said they had children to care for and were not aware of the regulations. They had also provided three negative covid tests in the last week and could quarantine at home, he argued.
He also said they will contest the charges and contended that it was a relatively minor offence with serious ramifications.
A challenge to the constitutionality of the law will be taken, he said. He submitted that people with Covid-19 were allowed quarantine at home and were not subject to the same restrictions as the hotel quarantine measures travellers faced.
He submitted that they did not have the funds for the quarantine fees and that refusal of bail was disproportionate for an offence which carries a one-month jail term.
Judge Walsh granted bail with conditions but it requires independent sureties to freeze bank accounts.
This means, the defence argued, that they will not be able to take up the bail until Tuesday when banks are open again.
Gardai were alerted on Friday afternoon by the State Liaison officer after the two friends flew in from the UAE and allegedly refused to agree to comply with go to a quarantine hotel.
A payment of the €2,500 fee for their accommodation was also sought, the court heard.
Breaking new 14-day hotel quarantine law for travellers arriving in the State can result in a €2,000 fine and a sentence of up to one-month in jail.
The measure was introduced to prevent the spread of coronavirus and is mandatory for people arriving from 58 states or if they have not had a negative Covid test taken within 72 hours.
The two women appeared separately before Judge Walsh.
Garda Inspector Luke Lacey, of Dublin Airport Garda station, said there were objections to bail due to their failure to comply with the statutory travel regulations introduced to avoid the spread of the disease.
Releasing them would make a “mockery of the Act”, he argued. He told the court that “extraordinary times required extraordinary measures”.
Distraught Kirstie McGrath was called in first. She wept throughout the hearing and at times shielded her face from the public gallery.
Garda Robbie Barber told Judge Walsh that Ms McGrath made no reply to charge.
He arrested her at 2.50pm, after he spent one hour and 50 minutes outlining the rules and giving her an opportunity to make phone calls for advice, he said.
“It was explained in ordinary language what would happen if she did not go to the quarantine hotel,” Garda Barber said.
She was also told state liaison officers would be at the hotel to explain the process but she refused to go, it was alleged.
Mr French said the rules were an erosion of his client’s constitutionality. She was entitled to bail and like her friend had no warrant history, and would comply with conditions at home, he submitted.
He explained that Ms McGrath had gone once to Dubai for cosmetic surgery but his client did not want to say it in open court.
A note was handed in and the judge read it and said it was for the purpose of breast enhancement, adding, “that is essential travel?”
Garda Karl Connor told the court that Niamh Mulreany also made no reply to charge. It was alleged he spent one hour and 45 minutes explaining the terms and he was also given a chance to get advice.
Mr French said that Ms Mulreany was on the lone parent’s allowance and needed to care for her child. Exceptions to the regulations are allowed and she could abide by conditions and remain in her home, he suggested.
He told the court that like her co-accused, Ms Mulreany had three negative Covid tests in the last week, one in Dublin before she flying out to the UAE and twice before she returned.
Judge Walsh noted Ms Mulreany had also gone for breast enhancement or modification surgery.
Both were supported by family members in the public gallery.
The two women did not address the court.
A pandemic was raging around the world and laws have been enacted which must be complied with, the judge warned.
She set identical bail terms in each case.
They were remanded on their own bonds of €800 each and they must lodge €500 cash. The judge also required independent sureties to be approved in each case, set at €2,000 of which €1,800 must be lodged and €200 has to be frozen in their bank accounts.
The defendants must surrender passports with immediate effect. Once the bail money is organised they can be released and must remain at government allocated hotels for 14 days unless they provide a negative PCR test after 10 days.
The two women must remain contactable by phone and not leave the jurisdiction except for essential travel. The cases will resume on April 9 next at Dublin District Court.
Legal aid was granted.

There's a set penalty/surcharge applicable to foreign (leisure) travel so that ought to apply, I guess. Going forward, the penalty ought to be normalised as a surcharge applicable to all air travel to offset climate damage and to promote staycations by offsetting some of the extra costa associated with the same.

Lawyers acting for two women who refused to enter quarantine after arriving in Dublin from Dubai must file legal papers for the constitutional challenge by Friday after the High Court ordered their removal from Mountjoy women’s prison to a designated quarantine hotel.
Legal experts said the bar was very high given the magnitude of the health emergency facing the State as it battles the global pandemic.
"I think it’s a very, very steep hill they have to climb. There will be a lot of deference shown by any court to the measures that are being challenged – that’s largely because of the separation-of-powers doctrine,” said Niall Michel, a partner at solicitors Mason Hayes & Curran who works in public and regulatory law.
“But also once they get under the bonnet, they will be required to produce a lot of detailed scientific and expert evidence to dislodge the evidence that the State will adduce in support of the measures and the basis for them and their proportionality and necessity.”
A second lawyer, who declined to be named, said a challenge was seen as inevitable given the severity of restrictions on personal movement that were so sweeping they would hardly be contemplated in ordinary times. The regime introduced new dimensions to the law that went beyond restrictive measures introduced in the 1940s to combat tuberculosis.

But the barriers to a successful challenge were all the greater because of anxiety about new coronavirus variants, which were compounding the health emergency, the lawyer added. “You’re dealing with a moving target that’s changing all the time.”
‘No lawful basis’
The next case follows weekend High Court proceedings in which a challenge to the legality of the women’s detention in Mountjoy was converted into a constitutional challenge against the 2021 Health Amendment Act, the law passed in March that introduced the hotel quarantine regime.
Lawyers for Niamh Mulreany and Kirstie McGrath have argued before the High Court that mandatory quarantine amounted to a form of preventative detention for which there was no lawful basis.
Michael French, solicitor for the women, declined on Monday to set out the basis for the constitutional challenge.
One aspect likely to feature is the argument that the legislation creates absolute liability offence, for which there is no defence if a person refuses to go a hotel. A further potential ground for challenge is on the proportionality of the measures in a situation where Ms Mulreany and Ms McGrath had three clear test results saying they did not have coronavirus.
One more was the fact that an appeal against mandatory quarantine can be made only after going to a hotel. Another potential ground for challenge is to question the status of the public official who decides whether a person can leave hotel quarantine, given the implications of the official’s decision for the person.
Procedural grounds
David Kenny, associate law professor at Trinity College Dublin, said it would be difficult to mount a successful challenge against the substance of measures establishing a mandatory quarantine regime. However, there could well be scope for a successful challenge on procedural grounds.
“If the State can show a good solid case for this being necessary to achieve an important objective, the courts defer to some extent to that determination,” he said. “They give a lot of room for the State to act in those situations.”
“This is broadly speaking a restriction on rights that the courts might uphold, but the devil might be in the details of how this law is executed.”
He saw potential to challenge the law on three questions: whether there was a way for people to provide a reasonable excuse not to go into quarantine; on the appeal process to review mandatory quarantine; and on whether there was an arbitrary dimension to the selection of countries for quarantine.
“Those arguments I still think might be challenging to win. But those are the ones that might succeed, which is to say that the courts would not say that it can’t be done but that it’s being done in an unacceptable manner,” Mr Kenny said.
If 3,677 miles is allowed then all points in between should be.
