The EU report said the change would give millions more workers for companies like Deliveroo, Uber and Bolt access to minimum-wage and legal protections.

As many as 4.1 million people working through food delivery and ride-hailing apps could be reclassified as employees under a forthcoming European Union plan meant to improve gig workers’ labor rights.

The draft proposal, seen by Bloomberg, could cost the sector up to €4.5bn more a year, the EU estimates. It would likely give millions more workers for companies like Deliveroo, Uber and Bolt access to minimum-wage and legal protections. Another 3.8 million workers would receive confirmation they are self-employed.

Shares in Deliveroo fell as much as 5.6% in early trading this morning while Delivery Hero fell 2.7%.

Digital platforms are pushing against the commission’s proposal, which they claim would lead to massive job losses. Earlier this year, Spain classified food delivery workers as couriers, prompting Deliveroo to pull out of the country and other food delivery apps to reduce their operations.

In a risk assessment, the European Commission wrote that it wasn’t possible to calculate potential job losses and that the rule changes may “negatively affect” workers’ flexibility. *****The rules are also likely to increase the cost of delivery and rider apps, as the EU executive noted that “consumers may be faced” with part of the platforms’ increased costs.***************

The bloc’s executive arm said the proposals were assessed to be the most effective way to improve conditions for workers and help them access social protections. Member states could see some €4bn in increased tax and social security contributions annually.

Under the proposed rules, which are expected to be made public next week, any worker whose job is controlled by a digital platform can presume that they are an employee regardless of what they are called in their contract. Digital platforms would have the legal obligation to prove that the worker isn’t an employee.

The rules would affect operations that meet two of five criteria: determining pay for workers, setting appearance and conduct standards, supervising the quality of work, restricting the ability to accept or refuse tasks, or limiting the ability to build a client base.

The commission will present its proposal next week and will still need to garner support from EU countries and the European Parliament before becoming law.

It'd be a shame if it applied to Free Now... I guess, as it's proposed, it would. However, I wonder if the lads who double and triple and quadruple job across several platforms could demand minimum wage from each?

It'd be a shame if it applied to Free Now... I guess, as it's proposed, it would. However, I wonder if the lads who double and triple and quadruple job across several platforms could demand minimum wage from each?

Will it really apply to Freenow? I get why it might apply to Uber et al as they are  rideshare and as such all rideshare work comes from the app.

However, Freenow only used licenced taxis who can source work from other apps, radio companies, by hail or on a rank. Think that's why Freenow ditched the limo's.

Anyway if it does apply to Freenow it will be interesting to see how that plays out.

Might be the right time for the driver owned co-op app to show its head. Can't get rid of that itch. Nearly did it but Whistle ruined the opportunity at that time.

I don't think it would apply to FN.  They don't tell us when to start/stop, we don't have to wear uniforms (car decals aside) and we can refuse any job they send us.  Apart from the weekend 'bribes', they have no control over us really.

Free Now is no different to Uber. Uber's drivers typically work for more than one dispatch firm. I guess you could construct similar arguments for and against all of the suggested measures in both cases. In any event, it's clear that the so-called gig economy has grown well beyond the bounds of insignificance. A realistic compromise could be a withholding tax on all relevant earnings similar to the regime applicable to certain professional services, subbies and absent landlords.

I agree that the apps are no different but Free-Now has a stronger case as it only signs up taxi drivers and therefore can make a stronger case that the taxi drivers are self employed as they many other potential  sources of income or work.

Where Uber drivers in other jurisdictions may only work for the Uber type apps. The NTA didn't allow them to operate their preferred ride-share business model.
As a result Uber in Ireland are effectively another version of Freenow.

Regarding the gig economy is it not more a question of the status of drivers employee vs self employed?

Recovering taxes whether from employers, employees or the self employed already has systems in place. Adding another layer (with holding) isn't necessary.


Cant remember where I read or watched it. But interesting topic about 'Late Capitalism'.
That today's world of the gig economy versus the power of companies/owners/capitalists and/or the 1% owning the majority of the wealth.
That it compares to pre-industrial revolution as the European feudal systems were dying out with revolutions because of the treatment of the working population.
Uncanny how much it mirrors today's world with the reversal of workers rights, representation and social contracts.
All started off with Reagan and Thatcher deregulating the markets and breaking the unions.
If it isn't addressed it will lead to revolutions again, off with Leo and Micks heads along with Zuckerberg, Musk and Bezos.

U wha First world war was a class war German Socialism V British Aristo Capitalism .If Socialism won then the Empire would fall or so they thought .Aristos sent working stiffs into battle to defend their wealth .But after the war Britain was broke and taxed the Aristos with Death Duty on big houses and land .They were assett rich put cash poor so handed over land and Gaffs to the state .The state then built gaffs for old soldiers and started the welfare state as they realized there were millions of trained soldiers now floating around who if organised could over trow the state .The Brit Aristo Class lost a lot but now with their educated sons in Power (Tory Party ) they organised Brexit look at UK GDP its going to crash and the Aristos who still have access to cheap capital will buy back what they lost .You can see it in the figures for how many people are now renters and not home owners and who own the Properties Just like the old fudal landlord system of old it only took them 100 years to regain what they lost .The Gig economy dosent suit them they need people to earn proper wages to be able to afford bigger rents .It time to go back to the 1900 no cars no Nightclubs no holidays just enough coin to eat and pay rent .GOD SAVE THE KING and his EMPIRE or at least his mates .See the new thing Co living spaces share the jacks and kitchens We use to call that Tennament Living .

If you are reading todays news Boris is taking one for the Party while he is getting the bollox kicked out of him the Brits have agreed to the ECJ being the final arbiter on and issues between Britain and the EU and they issued more fishing Licences to French Trawlers both these things were British Red lines never to be crossed .But Andy and Flo wont notice they are only concerned if Boros served Mince Pies or Pigs in a Blanket at the Downing Street Party .
