Title: Soilage charge for a 4yo puker?

Got quizzed today by a mom who obviously been charged the soilage charge when her 4 year old puked in someone's taxi.  Was it legal, she wanted to know?

I didn't know but I said I wouldn't charge if a child got sick.  Children will be children and do crazy things, I said.  I further opined, as one does, that I thought the soilage charge was really only for pissheads who couldn't control themselves.

So what do youse think?  Does the soilage charge apply to everybody, regardless of age?  Even a pet dog etc?  And would you charge the parents of a child if it got sick in your taxi?

no it's illegal. as she well knows i could get in to the back of her car while she's stopped at traffic lights, hose the interior down with slash and then get out and be on my merry way.

The age of legal consent inIreland is 12 years of age .So the Soilage Charge would not be enforceable by Law .

Are you still entitled to charge the soilage charge if the puker offers to clean the car out themselves.they usually offer to do it,and how can you insist on the charge then ?

Yes. It has to be professionally cleaned.

The age of legal consent inIreland is 12 years of age .So the Soilage Charge would not be enforceable by Law .

Passengers are jointly and severally liable for the fare... and, your contract is with the person who hired you.

There is no mention of what substance soiled the inside of your car.
Puke, piss, shit, blood, burgers coleslaw curry sauce, Beer, wine , no mention of the amount of soil,

No mention of age, or gender,
Soiling charge maximum€ 140

"Soiling – a fee may be charged where a passenger either soils the vehicle or damages it so much that the driver has to take it out of service or has to pay to have it cleaned or repaired. The maximum such fee is €140, but the actual fee charged may be lower – it should reflect the costs reasonably incurred by the operator."

Age of Criminal Responsibility. On 16 October 2006, under the Children Act 2001, the age of criminal responsibility was effectively raised from 7 to 12 years. Under the new provisions, no child under the age of 12 years can be charged with an offence.

Parent cannot be charged for a kid vomiting in a vehicle....call the cops and they'll laugh at you as the only person who can be fined is the puker, which is a kid, which is anyone under 18....nobody under 18 can enter a legal contract without permission. You can try shaming the parent into a fine but they are entitled to report you and look for compensation....and they will get it!

Thank you Brother Silver for your corection but I corrected the post earlier with (Age of Criminal Responsibility.) I find it strange that you would know the age of consent off hand ......Anyhoo thanks for the correction .

Yes I'd charge it, I couldn't care less if it was a new born baby or some old cunt on the way to get euthanized,  sick is sick no matter who's gut it comes out of.

If a child soils your car you charge the child...through the Parent.

I have NEVER received the soilage since I started driving a taxi .they just wont pay.I remember one night about 3 years ago.I picked up 2 fellas in towm .I didnt see that one of them had skeaked a pint glass full into the car.when they were getting out,yer man accidentally dropped the full pint over the back of the car floor.an argument ensued,we waited for the cops,as usual no show from the cops even 15-mins waiting.they got a pain in their holes waiting,they then walked away (without even paying the fair)said they were waiting no longer,and just walked off.now what am I supposed to do in those circumstances ? I ciuld not physiclly hold them down the

As LL alludes to your contact must be with the adult passengers, erm. Hence they are liable for the fare including such surcharges as may arise e.g. soiling fee.

I have gotten the full soilage charge about Ten times and also refused about half a dozen times.
The vast majority will pay up as soon as the Gardai are mentioned.

I'll put up a few stories in 'Kens tales' on this forum.
