I would imagine so. A little enforcement of the rules of the road would go a long way to reducing the number of casualties but that's about as likely as something with a very low probability.

It's really dangerous this time of year with all the drinking and Christmas parties, people can't get taxis so they have no other options to ring their wives to pick them up, with that many women drivers on the road late at night there's bound to be carnage.

Enforcement, enforcement, enforcement! Speed kills. Mobile phone use kills. Yet taxis racing around the roads with drivers fixated on their telephone screens is commonplace, particularly up above in Dublin. It's all great fun 'till lives are lost and/or insurance premiums increase.

Watched the darts myself. If it was that quiet you shoulda gone the other way. I was inundated with mytaxi offers in Drogheda last Sat night, well Sun morning to be pedantic. I didn't take any because it was after 02:00 so the bonus had ceased.

I was half thinking of trying days in Drogheda in the new year but I was up there yesterday and the traffic was atrocious, every bit as bad as up above in Dublin and, as I don't have a Loud licence, I wouldn't be able to use the official ranks so would be largely relying on mytaxi for work.

Just thought it might be satisfying to steal some work from those Loud men who dispatched all their immigrant drivers up to Dublin... not to mention the hundreds of country licensed drivers who work for mytaxi up above in Dublin.

TOP DOC DIES Cabbie quizzed by gardai after top psychiatrist Dr Martin Lawlor dies in Cork hit-and-run

A CABBIE is being quizzed by cops after a top psychiatrist died in a hit and run in the early hours of Saturday morning.

The collision happened in bad weather conditions on the N27 Airport Road on the outskirts of Cork city shortly after 5.30am.

Dr Martin Lawlor, 49, originally from Millstreet, Co Cork was employed by the HSE. He was highly respected in medical circles both in Ireland and the UK.

It’s understood he was walking towards Cork Airport where he was staying at a hotel when he was struck by a taxi which failed to stop at the scene.

The doctor had been due to catch a flight home to England, where his wife and children live.

Later at a garda checkpoint, cops noticed a taxi with a damaged windscreen and spoke to the driver about the earlier incident.

The driver, aged in his 60s, was arrested and taken to Togher Garda Station for questioning under Section 4 of the Criminal Justice Act.

The services of the State Pathologist’s office were requested and Dr Michael Curtis carried out a postmortem in Cork University Hospital yesterday.

Dr Lawlor was the programme lead and medical director of State of Mind Ireland which deals with mental illness in sport.

The airport hill in Cork is mostly a 100kmp speed limit and there is no street lighting on the top 2km section where the incident occurred.
There is no footpath on the airport hill but it does have cycle lanes on both sides.
Why the Doctor (RIP) was walking up that hill at 5am is a mystery to me, by 4.30am in Cork on even the busiest nights, we (Taxi drivers) will have the streets hoovered clean of customers and there would have been plenty of Taxies available from 4.30am onwards.

100 kilos/hour is crazy for a road with no footpath or centre median. I wonder if tiredness was a factor given the driver's age and the hour of day?

Unless they can prove yer man was walking in the middle of the road they might charge the driver.Even if the limit was 200kmph we're supposed to be able to stop or swerve if something unexpected comes up in front of us.Not always easy though.

Visibility was very poor here early on Saturday evening (7,8 ish) - at 100 kilos/hour you'd have little chance if that's what it was like down there in the early hours, IMO.

Gardaí who pursue children on scrambler bikes may be 'personally liable' if an accident occurs

Management has told officers ‘not to pursue’ these vehicles.

Mon 10:01 PM

GARDAÍ WHO GIVE chase to people using scrambler bikes could be held personally liable if the driver of the vehicle sustained injuries, TheJournal.ie has learned.

There has been a considerable crackdown by gardaí on the use of these vehicles in recent months but a grey area in current legislation means that they have no authority over their use – unless they are being driven on public roads.

There is serious concern for the safety of those who use the vehicles as well as for those who are in the vicinity of the bikes which are often driven by people with little to no experience of driving.

Currently, gardaí can only intervene when the bikes are being driven erratically on public roads or footpaths.

Now it has emerged that gardaí have also been advised by management not to pursue people on these vehicles as doing so may lead to injury or accident.

The biggest problem in relation to quad and scrambler bikes is the lack of legislation around them. Under the 1961 Road Traffic Act, a public road means a road which the road authority is responsible for maintaining.

However, it has emerged in recent weeks that gardaí who do intervene could be personally liable for civil action if the driver sustains injuries while being pursued by officers.
Management have warned officers to stick to the law until new legislations is brought in as they will not be able to support officers who find themselves the subject of litigation.

Government at both national and local level have been developing a number of strategies to combat the misuse of the vehicles and the anti-social behaviour associated with them.

Last year, 62 people were seriously injured in incidents relating to the vehicles. Residents in a number of communities have described how scrambler and quad bikes are becoming more common.

Armenian man Ilabek Avetian suffered devastating injuries earlier this year after being struck by a scrambler while sunbathing with his wife in a park in Darndale on the city’s northside.

Avetian lost an eye and suffered brain injuries as a result of the crash, with the public coming together to raise €30,000 for him and his wife once his story came to light.
Avetian’s partner Angela told of the devastation the incident caused to Ilabek.

She told the Sean O’Rourke Show on RTÉ Radio One: “My husband lived here for over five years and was working. All the time he told me about Ireland and that it is beautiful here.

“One month later – we decided to go to park and when we went to the park we were on the hill – we didn’t see him (the driver) because of light on my face. The motorbike ran over his face. At first I thought – Ilo – what happened – his face is all opened. His blood is on me. I saw the driver and I said what have you done – you killed the man – he looked at us and went.”

Limerick driver stopped going at a frightening speed on Christmas Day

CARL KINSELLA
This is just dangerous.

The Gardaí were out in force on Christmas Day, stopping 10 motorists for drink-driving, and seizing several vehicles being operated illegally.

Another post on the official An Garda Síochána Twitter page reveals that one motorist in Limerick was stopped going at a truly frightening speed.

According to the speed camera, the driver was recorded going at 192km per hour, virtually double the speed limit of 100km per hour on that road.

The tweet read: "Limerick Roads Policing Unit: Christmas speed detection operation yesterday 25/12/18 on the N18. One driver detected at 192km/h in 100km/h zone. Court appearance to follow."

Over 400 drivers caught speeding on St Stephen's Day

Updated / Friday, 28 Dec 2018 12:19

More than 400 drivers were caught speeding on Irish roads on St Stephen's Day.

An Garda Síochána said that 42,388 vehicles were monitored yesterday as part of the Christmas and New Year road safety campaign.

Of those, 414 vehicles were found to be in excess of the speed limit.

Examples of the speeds detected include:

124km/h in a 60km/h zone N7 Palmerstown Demesne, Naas, Kildare (roadworks)
142km/h in a 100km/h zone N25, Ballinaboola, Wexford.
112km/h in an 80km/h zone R339, Oranmore, Galway
81km/h in a 50km/h zone, R245, Carrigart, Donegal

Gardaí say that speeding is a major factor in fatal road traffic collisions and are appealing to the public to slow down to save lives.

The figures come after gardaí said that ten people were arrested on suspicion of drink-driving on Christmas Day.

Minister for Transport Shane Ross has thanked gardaí for "leading the crusade to save lives on the roads over the dangerous holiday period".

The minister said that both speeding and alcohol were killers.

He added that "a high level of garda enforcement will help to deter reckless drivers from endangering the lives of others and inflicting tragedy on their families".

Mourners bid farewell to ‘beguiling’ critic Eileen Battersby

Grieving daughter Nadia pays tribute to mother and friend ‘inspired by generosity’

Lorna Siggins

Literary critic, author and journalist Eileen Battersby was a “brilliant”, “beguiling”, “beautiful”, “courageous”, “dynamic” romantic who lived by her principles and eschewed social pretension, her funeral has heard.

“You never took leave of the kingdom of childhood,” said her daughter Nadia in a moving farewell to her mother at St Peter’s Church, Drogheda, Co Louth, on New Year’s Eve.

“True to form, you were unique, never subtle, bold as brass,” she told a packed congregation in the restored 18th-century church overlooking the river Boyne.

The award-winning former Irish Times literary correspondent – who latterly contributed to the Financial Times and Los Angeles Review of Books among other publications – was en route to feed horses with her daughter when she sustained fatal injuries in a single-vehicle crash in Co Meath on December 22nd.
She died in hospital on December 23rd.

President Michael D Higgins has led the many tributes which have been paid to her by national and international writers, artists, publishers, colleagues and friends.
Nadia recalled a happy atmosphere in the car in those few moments before the crash. Her mother had just sent her last literary review, they had shared a coffee, were listening to “techno” music, and were planning a trip to Prague together – “your first two weeks off in years”, she said.

“And then I lost you . . . ,” she said, expressing gratitude that her mother had sustained no lingering injuries, and had felt no pain.

“ Your heart kept beating for 34 hours, and I . . . was exactly where I needed to be,” Nadia continued.

She described her mother as romantic, who brooked “no pretension”, was “incapable of cunning or guile” and was “disturbed by hypocrisy, inspired by generosity, forgiveness and redemption”.

Qualities of wit, courage, brilliance, vision, loyalty, grace, elegance, and capacity to love imbued her upbringing and “like most romantics, you were very vulnerable”, and easily hurt, she said.

“You never took leave of the kingdom of childhood,” said Nadia, instead finding “purity” in music, art, literature and in the animals that they both loved at their Boyne valley home.

“No words can describe the violence of this pain,” she concluded, expressing her grief and regret that her mother would never see her own children.

“No daughter had a better mother . . . ,” she said, turning to her “singular, dynamic friend”, before reading the words of Francis Ledwidge’s poem, Lullaby.

Nadia’s father, former attorney general and barrister John Rogers, paid tribute to Battersby’s “maverick spirit” and her “principled position on the big issues and the everyday”.

She led an “endlessly working life”, he said, recalling her journalistic career which began in London. During a series of memorable interviews for The Irish Times, her method had involved not so much posing questions as “talking about herself”, he said.

It proved highly successful, although it was not a technique he could have employed in his own legal profession, he observed.

Mr Rogers described the high esteem in which she held certain writers, ranging from Joseph Roth to WG Sebald to Dostoevsky, and recalled their detailed walks with Nadia through the archaeologically-rich landscapes of Kildare and Meath.

An Irishwoman’s Diary, published in The Irish Times on December 22nd, 2001, encapsulated Eileen’s spirit, he said. In her diary, the journalist recalled how she was driving with Nadia, then aged five, in Co Offaly when the door of a trailer carrying their dogs inadvertently opened.

All dogs were eventually recovered, even a missing puppy after a search of nine miles of bog road”on foot, by bike and by car” into the night. All the while, Nadia had insisted the puppy was alive – “ please keep on looking”.

Reading from Patrick Kavanagh’s poem, Is, Mr Rogers recalled how an argument about it with Eileen convinced him that she did not accept that it was enough to “look on”, and that life was about “engagement and participation”.

She left “nothing unchallenged”, he said.

Shakespeare’s Sonnet 116 was read by Prof Cecily Kelleher, William Blake’s Tyger, Tyger was read by barrister Frank Callanan, and an extract from Joseph Roth’s The Emperor’s Tomb was read by editorial director Neil Belton, publisher of Ms Battersby’s recent novel Teethmarks on My Tongue.

Writer and close friend John Banville was moved to tears when reciting Philip Larkin’s poem, Cut Grass:
Cut grass lies frail:
Brief is the breath
Mown stalks exhale.

Music by organists Brian McIvor and David Lambe, pianist Michael Holohan, cellist and organist Claire Fitch, and singers Niamh Browne and Bríd Ní Ghruagín included some of Ms Battersby’s most loved pieces by Chopin and JS Bach – the latter once described by her as “God’s own composer”.

Hymns included the carol, Silent Night, which had informed her last contribution to RTÉ Radio’s Sunday Miscellany – broadcast on Christmas Day.

The service in the Protestant church, dating from the 12th century with centuries old bells - and once attacked by Cromwellian forces as Ms Battersby had recorded in this newspaper- was led by Rev Iain Jamieson.

Her wicker coffin – bedecked in roses, lilies, heather, and with a photograph of her with one of her horses,Sophie – was borne out by her daughter Nadia, with close friends Lauren Savage, Jessica Kinsey, Venetia Taylor, Lydia Roche, Olivia Gray and Sophie Soar.

Chief mourners with Nadia and Mr Rogers were Ms Battersby’s mother, Elizabeth Whiston, sister Elizabeth, brothers Bill and Breffini, and Barry and Ann Battersby.
President Michael D Higgins was represented by his aide-de-camp Comdt Dorothy Donnelly. And among the many in attendance were colleagues from literature and publishing, including Susan Curtis, Katie Donovan, Peter Fallon, Luke Gibbons, Anthony Glavin, Alan Hayes, Sinead MacAodha, Michael McLoughlin, Declan Meade, James Ryan, Ronan Sheehan, Dermot Somers, Gerard Smyth and Jonathan Williams. Friends and neighbours included Johnny Burke from Kiltale, Co Meath, who was due to supply her with hay for her horses on the day she died.

Colleagues from the legal profession included Frank Callanan, Patrick Gageby, Hugh Hartnett, John Maher, former Court of Appeals judge Garrett Sheehan, Mr Justice John Mac Menamin, Jim McCullough, Pól Ó Murchu, Donal Spring and undertaker and solicitor Billy Loughnane.

The Irish Times was represented by Managing Director Liam Kavanagh, Deputy Editor Deirdre Veldon, Human Resources Director Majella Gallagher, Managing Editor (Features) Brian Kilmartin, Picture Editor Brenda Fitzsimons, Arts Editor Hugh Linehan, Deputy Features Editor Róisín Ingle, News Editor Mark Hennessy and Sports Editor Malachy Logan.

Colleagues from past and present in journalism included Sarah Binchy, John Burns, Joe Carroll, Gerard Cavanagh, Carol Coulter, Deaglan de Breadun, NUJ Irish secretary Séamus Dooley, Deirdre Falvey, Michael Foley, Yvonne Haugh, Paul Gillespie, Sarah Geraghty, Bernice Harrison, Joyce Hickey, Mary Maher, Audrey Magee, Helen Meany, Mairin McGrath, Frank Miller, Susan McKay, Orna Mulcahy, Patsey Murphy, Kathy Sheridan, Mary Sheridan, Campbell Spray, Paddy Smyth, Irene Stevenson, Maol Muire Tynan, Joe St Leger and Sheila Wayman.

Cremation took place at Glasnevin Crematorium.

That seems a strange one, I would have thought that the Main street in Ballincollig was one of the safest roads in the country, fer starters it is all within a Safety camera zone and one which is reguarly patrolled by safety vans, also it has Two junctions with traffic lights and numerous traffic lighted pedestrian crossing and also boasts some of the highest speed ramps in the county.
R.I.P. to the young lass.

It just seems strange that the children's father was not mentioned in any news report or on the RIP website.
As the mother has passed on then sole guardianship of the children falls to the father but he got no mention anywhere.
Even if he was also Passed on, there would have been a reference to her late husband ??  Strange ?

Elderly couple (70s) killed after car crashes into roadside bog

Rachel Farrell and Ian Begley

Gardai are appealing for witnesses following a fatal collision in Co Monaghan this evening.

The man and woman, who are both in their 70s and locals of the area, were killed in a single car crash near the Monaghan and Armagh border at Killyneill Cross shortly before 6pm.

Gardai and emergency services were called to the scene shortly before 6pm, when the alarm was raised that a car travelling on the route had left the road and ended up in a nearby bog.

It is believed their car had become submerged in water.

The two people, who were the only occupants of the car, were removed and pronounced dead at the scene a short time later.

The local Coroner Dr Watters attended the scene and both bodies will be removed to the mortuary at Monaghan Hospital later this evening.

Garda forensic collision investigators will examine the scene tomorrow morning. The R213 road is currently closed and local diversions are in place.

Local Cllr Paudge Connolly told the Irish Independent that the entire community is numb with grief.

“Everyone in our tight-knit community is in a total state of shock,” he said.

“At first we heard there was an accident and then we learned that there were two fatalities.

“It’s been a very upsetting day and my sympathies and prayers are with their families."

Anyone with information is asked to contact Gardaí at Monaghan 047-77200 or the Garda Confidential Line 1800 666 111.

This latest tragedy comes as the fifth death on Irish roads this week.

On Thursday evening, a male pedestrian in his 40s died after he was struck by a 4x4 vehicle on the Dublin Road in Monasterevin.

Earlier in the day, Dublin woman Jackie Griffin was killed in a collision on the M50.

And shortly after 9am on the same day, a female passenger in her 80s died after the car she was travelling in was involved in a serious collision in Loughrea, Co Galway.

Then on Sunday night, a 60-year-old male died after he was struck by a truck in Dungarvan, Co Waterford.

Four young men in their 20s have been killed in a crash in west Donegal.
The single vehicle crash happened shortly before 9pm last night on a local road near Magheraroarty close to Gortahork.
Gardaí say the four men, all understood to be in their 20s, were pronounced dead at the scene a short time later.
The scene where the crash happened, has been preserved for a technical examination and diversions are in place.

At least they didn't kill any other motorist or innocent bystanders....and won't be able to in the future!!

Drunk driver was speeding when he crashed into pedestrian who later died

Court heard driver, who had no experience of driving and no driving licence, fled scene after crash

Rene Miko of Place de Plouzane, Kilrush, Co Clare,  pleaded guilty to drink driving and dangerous driving causing death at at Ennis Circuit Court.

A motorist was three times over the drink drive limit when he drove at 120km/h in a built up area of Ennis before he struck a pedestrian on a footpath at a roundabout who later died from his injuries, a court has heard.

Slovakian national, Rene Miko of Place de Plouzane, Kilrush, Co Clare, was before Ennis Circuit Court on Friday where he pleaded guilty to dangerous driving causing the death of GAA coach, Eugene McNamara (42) on the night of October 26th 2016. He also pleaded guilty to drink driving having had a blood alcohol reading of 170 mg of alcohol in his system when the legal limit is 50mg.

Mr McNamara was walking on the footpath on his way home after watching a soccer match on TV at his brother’s house when he was knocked down.

CCTV footage shown in court captured the speed of Mr Miko’s BMW and Mr McNamara walking along the footpath opposite McDonalds in Ennis before the fatal impact. The speed limit in the area was 50km/h.

The footage showed Garda Michael O’Connor of Roxboro Rd Garda Station, Limerick, who was off duty at the time, doing a u-turn on the Gort Road leading into the roundabout to pursue the defendant’s car after he saw it speeding.

Garda O’Connor, in a statement, noted that before the defendant’s car struck Mr McNamara, it first hit another car causing it to become airborne.

The garda investigation found the defendant’s car made no effort to reduce its 120km/h speed before coming into the roundabout.

Judge Gerald Keys told the defendant he is facing jail but has allowed him remain on bail pending sentencing on March 25th.

In a victim impact statement Stephen McNamara, a double All-Ireland winner with the Clare hurlers from the 1990s and a brother of Eugene, said the victim “was cruelly knocked down by a speeding car and was left to suffer alone by the side of the road. It is a picture that haunts all of his family and remains with us”.

Meanwhile CCTV footage showed the defendant and his passenger get out of their car and flee the scene. They ran across the nearby Fairgreen park to New Rd at Rice College before they were apprehended by Garda O’Connor at Marian Avenue.

Mr McNamara died a number of days later from his injuries. Assistant State Pathologist, Dr Margaret Bolster found he died from severe traumatic brain injury as a result of blunt force trauma in a road traffic collision.

In his first garda interview, the defendant maintained his right to silence. It was only after gardaí retrieved forensic evidence showing Mr Miko’s DNA from the air bag on the driver’s side of the vehicle that he said: “I am maybe 30 per cent to 40 per cent responsible but I can’t be 100 per cent responsible because I don’t think I was the driver.”

Counsel for the State Lorcan Connolly BL said Mr Miko said he didn’t have a recollection of the incident.

Mark Nicholas SC, defending, said Mr Miko “had no experience of driving, had no driving licence, had no car and had no history of driving and no ambition to drive in any way”.

He said that his client pleaded guilty but couldn’t at first admit to driving as he didn’t remember what happened. He added that his client’s driving on the night caused catastrophic consequences and he apologised. He had no previous convictions.

Mr McNamara said his parents never have a night where they are able to sleep without waking and thinking of what happened Eugene on his walk home that night.

'No justice for my son' - mother of teen killed in head on crash by driver 'convinced Islamic State taking over'

John Gorman (19) was driving home with his younger brother in December 2015, when their car was hit head-on

Court of Appeal quashes jury's guilty conviction and instead commits Dariusz Alchimionek (44) to Central Mental Hospital

Court previously heard how Alchimionek became convinced that Islamic State (IS) was about to invade

A heartbroken mother has said she cannot see any justice for her teenage son who was killed in a horrific car crash.
John Gorman (19) was driving home with his younger brother, Adam, on December 29, 2015, when their car was hit head-on by a vehicle that had crossed the road.

John died in the crash, at Ballycrystal, Geashill, Co Offaly, which happened only 8km from the brothers’ home in Walsh Island.

Sixteen-year-old Adam suffered serious injuries and was rushed to the Midlands Regional Hospital in Portlaoise.

Last week, the Court of Appeal quashed a “guilty” jury verdict in relation to the case.

The driver of the oncoming car, Dariusz Alchimionek (44), had denied the manslaughter of John and assault causing harm to his brother.

In April 2017, a jury returned majority guilty verdicts on both counts, despite unanimous expert opinion that Alchimionek, of Barrow Way, Spa Street, Portarlington, Co Laois, was legally insane.

John’s grieving parents, Ann and James, were at the Criminal Courts of Justice yesterday when Alchimionek was committed to the Central Mental Hospital.

Ann said her two other children, Joanne and Adam, had attended all the other court hearings, but had “given up on the justice system”.

“We got nothing out of it,” she said, adding that the family had spent three years fighting.

James said: “The accused has a right to a fair trial. He has a jury and a judge and he can appeal. John got none of that.

“You don’t have a voice in the court setting, apart from the victim impact statement.”

Ann said the decision to overturn the jury’s verdict was “heartbreaking, because we had fought so hard”.

Adam recovered from his physical injuries and would like to go to college, said James.

The couple became grandparents to little Kayla, who was born to Joanne last November.

“I do believe it was a gift from John to help us,” said Ann.

Paying tribute to her son, she said John, who was studying computer science, won a role model of the year award in his sixth year at Colaiste Iosagain in Portarlington.

A member of teaching staff who attended John’s month’s mind mass said: “You only meet someone like John once in your career.”

Ann and James were told about the crash by a family member.

On learning that John had died, James said: “You know at that stage your whole life is changed. He had everything going for him.”

There were only two years between each of the children in the family, which was a very close-knit unit.

Asked how they were coping, Ann said: “Struggling. Every day, every hour.”

James added: “You got some closure when Alchimionek was found guilty, but this has opened it all up again.”

Tullamore Circuit Criminal Court previously heard how Alchimionek became convinced that Islamic State (IS) was about to invade Europe and a third world war was about to begin.

Consultant psychiatrists from the Central Mental Hospital told the court he met the criteria to be found not guilty by reason of insanity.

The jury had the option of returning a verdict of guilty, not guilty and not guilty by reason of insanity. After two hours and 50 minutes of deliberations, it returned majority guilty verdicts.

Alchimionek was given a nine-year prison stretch, with the final three years suspended in October 2017.

However, the Court of Appeal quashed the jury’s guilty verdict last week on the grounds that it was “perverse” and against the weight of the evidence.

The three-judge Appeal Court heard yesterday from Dr Paul O’Connell, consultant psychiatrist at the Central Mental Hospital, who recently assessed Alchimionek.

Dr O’Connell said that in his opinion, Alchimionek warranted continued detention as an in-patient at the hospital.

On foot of the assessment, the court committed  him to the Central Mental Hospital.

Garda convicted of careless driving causing death of woman (75) ordered to pay €5,000 to charity

A garda whose careless driving caused the death of a 75-year-old pedestrian has had a nine month prison sentence deferred on condition he pay €5,000 to a charity.
Warren Farrell (33), a garda serving in Ballyfermot, Co Dublin, was driving a marked patrol car in response to an incident at a Topaz garage when his vehicle struck Elizabeth Core.

Gda Farrell had pleaded not guilty at Dublin Circuit Criminal Court to dangerous driving causing the death of Mrs Core at Fonthill Road South, Dublin, on August 28, 2014.

After a trial last December a jury convicted Gda Farrell by majority verdict on an alternative charge of careless driving causing death. Judge Cormac Quinn had advised the jurors they could convict on this alternative charge.

Yesterday morning Judge Quinn said the degree of Farrell's culpability was in the lower range. He said the aggravating factor was his speed.

The trial heard that after seeing Mrs Core crossing from the far side of the road Gda Farrell failed to slow the car. He later told investigators that he believed Mrs Core would see or hear the patrol car and stop crossing and return to her side of the road.

He said he was surprised that she continued to cross the road and immediately applied brakes and entered the bus lane to avoid hitting her.

Gda Farrell said he attempted to mount the car onto the footpath on his left but was unable to do so and the left tyre burst. The front right of the car hit Mrs Core and she was pushed onto the front windscreen.

Forensic investigators put the car's speed at the point of impact, following heavy braking, at between 50 to 56 kmh. The speed limit on the road was 50 kmh.

Judge Quinn said there is a tension between the duty imposed on gardaí to respond to calls as quickly as possible and the duty not to endanger the public.

He said there was evidence Gda Farrell experienced a “violation of expectancy” where he had expected Mrs Core to stop crossing.

When he saw she continued to cross he reassessed the situation and applied the brakes. Judge Quinn noted that as a result of this up to 2.5 seconds in stopping time were lost.

At a hearing last month Thomas Core, Mrs Core's son, described his mother as “a singer and a dancer” and “the life and soul of family gatherings”.

Reading from his victim impact statement, he said his mother had been fit and healthy for her age and had many more years of her life left. He said his father's health deteriorated after his mother's death and he passed away “almost two years to the day she died”.

Judge Quinn extended the court's sympathy to the Core family. He said that while the consequences of the “bad driving” must be taken into consideration they were not the determinative factor.

He ordered that Gda Farrell pay a fine of €2,000 as well as pay €5,000 over to the Irish Road Victims Association in the next four months. He set a proposed prison sentence of nine months which he deferred under section 100 of the Criminal Justice Act 2006 where a court can defer sentence under conditions.

At last month's hearing Detective Superintendent Colm O'Malley offered “sincere condolences” to the Core family for their tragic loss on behalf of Gda Farrell and An Garda Síochána.

He agreed with defence counsel Patrick McGrath SC that Gda Farrell had always wished to extend his condolences personally, but that it would not have been appropriate while the court case was ongoing.

James Butler, an investigator with the Garda Síochana Ombudsman Commission (GSOC), told the court that Gda Farrell told GSOC investigators that he had been satisfied before collision that his car's blue flashing lights and sirens would have alerted Mrs Core and she would have remained on her side of the road.

Mr Butler told James Dwyer SC, prosecuting, that Gda Farrell said he continued driving at the same speed as a result. Some civilian witnesses during the trial testified that the siren or blue lights were not on when they saw the car before the collision.

Mr Butler said the Director of Public Prosecutions had rejected an offer of a guilty plea on careless driving causing death and the matter went to trial.

He agreed with Mr McGrath that Gda Farrell had taken evasive action before the collision, but his vehicle's tyre burst and he was unable to mount a footpath to avoid impact.

Hit-and-run driver who seriously injured cyclist was banned from driving, has 92 previous convictions - court hears

Declan Brennan
March 15 2019 7:31 AM

A hit-and-run driver who was banned from driving when he seriously injured a cyclist has been jailed for five years.

Jonathan Wainyae (33) of St Attracta Rd., Cabra, Dubliln pleaded guilty at Dublin Circuit Criminal Court to dangerous driving causing serious bodily injury and to failing to stop at the scene of a collision at Strand Road, Baldoyle, Dublin, on July 9, 2016.

Judge Patricia Ryan sentenced Wainyae to six years imprisonment for the dangerous driving offence with the final year suspended on conditions.

These include that he keep the peace and be of good behaviour for three years and engage with the Probation Service for 18 months post release. She also disqualified him from driving for 25 years.

Judge Ryan also sentenced him to two years imprisonment for the charge of failing to stop at the scene. She backdated both sentences to July 12, 2018 and said they would run concurrently.

Detective Sergeant David Ennis told the court that the victim was well illuminated on the night. Jones Justino DaSilva was cycling home around midnight after finishing a shift in a restaurant in Howth when he was knocked off his bike by a car driven by Wainyae.

He suffered a spinal fracture and fractures to his right leg and as a result he was unable to continue working. He told the court that the effects of the injuries put a strain on his marriage and he and his wife eventually split up.

In an emotional statement to the court Mr DaSilva, a Brazilian national, said he came to Ireland with his wife to improve his English.

He said that after the accident he thought he was going to die. He said the period afterwards was very difficult and it took him a long time to recover.

Speaking through a Portuguese translator, he said he had to return to Brazil after the accident and felt depressed and suicidal at times.

“It changed my life very much. I had so many plans. My life was turned upside down. My marriage broke down,” he said.

In a written apology, read out in court by his defence barrister, Pieter Le Vert BL, Wainyae said “if I could turn back time and change what happened, I would.

“I would like to apologise to you and your family for the hurt and pain I have caused you. I only wish that I could sit down with you and explain in person that I thoroughly regret my actions.”

Wainyae, who was subject to a driving ban when he hit the cyclist, told the victim that “you were in the right place, it was me that should never have been on the road that night.”

He finished by saying “I don't expect you to forgive me. I do want you to know how sorry I am”.

Responding to this Mr DeSilva told the court that he accepted the apology.

“I have no issue against him. I would like this situation to make him think and he can have a better life in the future. It was probably a very hard time for both of us.

“From now on I can do my life and he can do a better life,” he said.

The majority of Wainyae's 92 previous convictions are for road traffic offences, but he also has convictions for assault, theft and drug dealing. Mr LeVert said he went into custody in 2014 and came out with a “full blown” heroin addiction.

He is currently serving a five year prison term imposed in 2016 for robbery. His barrister told the court that he is engaging with an addiction treatment programme in custody.

Judge Ryan said the aggravating factors in the case were his initially denying any involvement, his being disqualified from driving at the time, his having had 12 disqualifications in the past and the effect the collision had on the victim.

She said the mitigating factors in the case were his guilty plea, his apology, his remorse, his efforts at rehabilitation and the fact that he is using his time in custody well.

The tram crashed about 5 hours ago and they're still down there now trying to move it with lots of traffic delays and diversions. At least with a bus you can tow it easily and send out another.
The Luas  was knocked off its track, probably have to get heavy lifting equipment in to lift it away.
But I do get what you are saying about just towing a bus away

At least 8 hospitalised following Luas and bus crash

Updated / Saturday, 16 Mar 2019 09:55

At least eight people have been taken to hospital following a collision between a Luas tram and a bus in Co Dublin.

The incident happened at Queen Street in Smithfield, and the road is closed while emergency services attend the scene.

Gardaí said the road is expected to be closed until at least lunchtime today.

The tram was derailed in the crash, and remains at the scene. The incident happened at around 7am.

A number of those involved were taken to hospital as a precaution. The injured people include the driver of the tram and four ticket inspectors.

As a result of the incident, the Luas' Red Line is disrupted.

Services are operating from Tallaght/Saggart to Blackhorse, but there is no service operating between Blackhorse and Connolly/The Point.

Those who has bought Luas tickets will be able to use them on Dublin Bus.

Updates are available on the Luas website and social media channels.
First Responders say their efforts are being hampered by skobes climbing into the wreckage, then demanding to be cut out!

A motoryclist has died following a collision in Cork.

The accident occurred just off the N28 Cork-Ringaskiddy road between 7pm and 8pm this evening.

The motorcycle was involved in a collision with a car at Loughbeg just outside Ringaskiddy village and the cyclist, a man in his 40s, suffered critical injuries.

Desperate attempts were made to stabilise his condition at the scene by paramedics so he could be transferred to Cork University Hospital (CUH).

Tragically, the biker suffered multiple critical injuries in the incident and was pronounced dead at the scene before he could be transferred to CUH.

The driver of the car was uninjured but was treated at the scene for shock.

Gardaí have closed a portion of the Loughbeg road to assist the work of the emergency services and Garda forensic collision investigators.

The N28 Cork-Ringaskiddy road is unaffected.

Motorists have been urged to avoid the area if possible as there are lengthy delays.

The man's body will be transferred to CUH where a full post mortem examination will be conducted on Wednesday.

Togher Gardaí have also appealed to anyone who witnessed the collision to contact them at (021) 4947120.

Motorists or taxi drivers whose vehicles are equipped with dash cams and who passed the area at the time are likewise asked to contact Gardaí.

The man's death marks a grim week on Irish roads.

He is the second motorcyclist to die on Irish roads in the past 36 hours.

Road fatalities have soared in the first three months of this year compared to the same period in 2018.

A total of 40 people have died on Irish roads so far this year.

A GAA community has been left devastated after a former player and son of a club founder died in a tragic motorbike accident.
Robbie McCabe, aged 39, died when his motorbike crashed on Whitestown Way, Tallaght, Dublin, early yesterday morning.

David Reynolds, secretary of St Judes GAA Club in Templeogue, just 5km from the accident scene, said everyone at the club had been left in shock at the loss of a man who had been involved until recently in the club since before his fifth birthday.

"Robbie had been involved with the club from under five years old. His father Martin was one of the founding members," said Mr Reynolds.

"So the family are a major part of the club. It's so sad a loss. Robbie was still involved as a member. He was a gentle, lovely guy - an absolute gent, quiet and unassuming."

Mr McCabe worked as a barman in Devitts Pub on Camden Street and had been living in Tallaght, although he was brought up in Templeogue and still had strong connections there.

Gardaí appealed for witnesses to contact Tallaght garda station on 01 666 6000, the Garda Confidential Line on 1800 666 111, or any Garda station.

Mr McCabe's tragic death brings to 39 the number of people who have died on the country's roads so far this year.

Both victims were the sole occupants of their cars, which ended up on the opposite side of the usually busy road.

They were removed to the Dublin City Mortuary in Whitehall, where a post-mortem was due to take place.

The road was closed in both directions for a few hours, which caused traffic chaos in the area.

A Garda spokeswoman said: “A technical and forensic examination of the scene is currently under way.

“Gardai are appealing to motorists with dashcams or anyone travelling on Drumcondra Road Lower between 5.45am and 6.15am to contact Mountjoy Garda Station on 016668600, the Garda Confidential Line 1800-666-111 or any Garda station.”

Labour Senator Aodhan O Riordain said today: “Such terrible news from Drumcondra this morning. Deepest sympathy to families and loved ones affected.”

Drivers were diverted this morning at Whitehall Church, Botanic Avenue and Richmond Road, and buses and HGVs along Clonliffe Road towards Ballybough.

The deaths come after a deadly bank holiday weekend on the roads, which saw four people lose their lives.

Judge says young men 'using roads as their own private race tracks' as teenager jailed for careless driving causing the death of girl (16)

Ralph Riegel
March 26 2019 4:22 PM

A JUDGE jailed a teenage motorist for careless driving causing the death of a 16 year old girl as he warned that some Irish drivers, particularly young men, were treating public roads like their own personal race tracks.

Judge Eugene O'Kelly jailed Edward O'Shea (19) for 14 months after he noted that the victim, Kate 'Katie' Murphy (16), had sent a Snapchat video to a friend just seconds before the fatal Waterford collision in which she said they were: "Probably going to die in the car."

An unidentified male voice replies: "Yeah, probably."

A female voice then commented: "Cheeky - going over the speed limit."

An unidentified voice replied: "Cheeky - going twice over the speed limit."

A Waterford Circuit Criminal Court jury was not shown the social media videos during the trial because they were deemed to breach the hearsay rule.

Judge O'Kelly said Ireland now had to review such real-time video evidence from social media in the trial context.

In jailing O'Shea, he said the careless driving was at the upper end of the scale.

He also said it "beggars belief" that O'Shea, a learner driver, could treat such a powerful car as his own.

"Some drivers, particularly young men, treat the roads as their own private race tracks and do so without any regard for the potentially catastrophic consequences for other road users and indeed for themselves," he said.

Judge O'Kelly noted that the so-called Clancy Amendment about unaccompanied learner drivers could not apply as the Tramore collision occurred before it was passed into law.

However, he noted how O'Shea had been driving a powerful and modified Japanese car unaccompanied.

"Such driving is not only illegal it is dangerous."

The heartbroken Murphy family claimed they lost their only daughter in the fatal road traffic accident because O'Shea, driving while unaccompanied on a learner permit, lost control of a powerful modified Japanese car while showing off to his friends.

Edward O'Shea, who is now 19, was jailed for 14 months after being convicted before Waterford Circuit Criminal Court of careless driving causing death and careless driving causing serious injury.

He was acquitted by the jury last February of dangerous driving causing death.

Kate 'Katie' Murphy (16) died when the Japanese car with a specially lowered suspension, being driven by O'Shea, spun out of control and collided side-on with a wall outside a Tramore housing estate on October 5 2016.

The car also had low profile tyres and a side skirt.

The accident area was covered by a 50kmh speed limit but, because there were no brake marks, it was impossible for Gardaí to determine what speed the Toyota was travelling at.

Forensic experts were only able to determine the car finally hit a stone wall side-on while travelling at around 32kmh.

However, locals had noted the sound of a car travelling at speed that day along the winding Cliff Road.

One woman was so alarmed by the sound she got out of her armchair in her home to investigate - and seconds later heard the sound of the impact.

Two other teenage occupants of the car, Joseph Walsh and Jessica Fynn, suffered horrific head and chest injuries in the accident at the Cliff Road, Newtown outside Tramore.

Ms Murphy's heartbroken parents, Hilary and Vivienne, said their lives have been devastated by the loss of their only daughter in a crash which they insisted was entirely avoidable and due to O'Shea's carelessness.

The imported Japanese car, with a twin-cam engine and a specially lowered suspension, was registered to Edward O'Shea's family garage, run by his father, Michael, and he was driving under a garage insurance policy that day.

Judge O'Kelly noted the fact.

"It was extraordinary and blatantly irresponsible for the O'Shea Garage business to facilitate the driving of such a car (by a young learner driver)," Judge O'Kelly said.

Katie's father said they were convinced about what happened.

"In my view, we lost our daughter because Mr O'Shea was showing off driving a high powered car," Mr Murphy said.

The Tramore father described Edward O'Shea as "a very cold-hearted person" who had not spoken to his family, sent a letter, card or flowers over their daughter's death.

"He has destroyed our lives."

Mr Murphy urged Judge Eugene O'Kelly not to adopt a "soft touch" approach to sentencing and to take the opportunity to send out a deterrent message to other Irish road users.

Mrs Murphy said the tragedy was every parent's worst nightmare.

"Her death is my past, my present and my future," she sobbed.

"Edward O'Shea's selfish and careless actions have taken away my only daughter.

"Katie's bedroom door (in our home) is my biggest nightmare. It holds hope but there is no hope to be found."

Mrs Murphy said that people are now afraid to look in the face of herself and her husband lest they see "every parent's worst nightmare."

Mr Murphy said they have launched a road safety campaign in their daughter's memory - and urged young people worried about a driver's speed to have the courage to demand to get out of the vehicle.

O'Shea, who appeared in court wearing black slacks and a navy shirt and tie, sat with his head bowed as victim impact statements were delivered by Katie Murphy's parents and her brother, Scot.

The defendant, in a letter handed in to Judge O'Kelly, apologised for what his careless actions behind the wheel that day had inflicted on three families.

"If I could change what happened believe me I would change everything," he said.

The court heard that O'Shea now suffers from survivor's guilt, depression, anxiety and post traumatic stress disorder over what happened.

He has been attending a counsellor for over two years and had been subjected to social media condemnation over what had happened.

"I hope that one day you (the Murphy family) will be able to forgive me but I want you to know that I am truly sorry.

"So many people have been affected by my bad judgement that day."

The parents of Joseph Walsh, John and Phil Walsh, handed in a letter in which they said they hold no ill will towards the car driver.

O'Shea was found not guilty by a Waterford Circuit Criminal Court jury last month of dangerous driving causing death and serious injury.

He had offered a plea to careless driving causing death and serious injury before the trial started.

O'Shea, an apprentice mechanic, was 17 at the time of the tragedy but is 19 now.

He had been driving on a provisional license for just five months when the tragedy occurred.

Ms Murphy, of Castlewoods, Ballinamona, Waterford was a rear seat passenger in the car along with her friend, Jessica Flynn.

O'Shea of Magnh, Fenor, Waterford was convicted of careless driving causing death and careless driving causing injury.

He was disqualified from driving for six years and fined €800.

A seaside community is in mourning following the tragic death in a road accident yesterday evening of one of its best known and popular residents.

Padraig Doherty died when the pick-up vehicle he was driving left the road and crashed through a wall on the N59 (Ballycroy) road outside Mulranny.

Mr Doherty, who was in his 60s, is a member of the Doherty family which is steeped in the business life of Mulranny.

His brother, Tom, and his family run the Costcutter Store and a bar in the west Mayo village.

It is understood that a young boy was in the vehicle when the accident occurred at around 7pm on Sunday.

The youngster was not seriously injured.

According to local county councillor Michael Holmes, the Mulranny area has been rocked by the tragedy.

“Padraig was involved in local construction projects as well as the aquaculture industry”, Councillor Holmes explained.

“He was deeply involved in many local initiatives including fund-raising for charity”, he continued.

Councillor Holmes went on to describe Mr Doherty as a most careful and diligent individual who never smoked or drank.

No other vehicle was involved in the impact.

Emergency services attended the scene of the crash.

Tributes have been paid to a 21-year-old man who died in a fatal collision in Co Tipperary on Monday night.

The young man has been named locally as Jake Anderson.

Mr Anderson was from the village of Clerihan, near Clonmel.

He died when his car collided with a truck on the N24 at Ballingarrane at about 8pm last night.

Mr Anderson was pronounced dead at the scene, while the driver of the truck escaped without injury.

Mr Anderson, who has been described as a “popular and cheerful” young man, was an avid rower with Clonmel Rowing Club.

A spokesperson from the club told Independent.ie that his death has come as a terrible shock to the entire community.

“Jake first joined the club at 14 and was always so supportive and positive, especially to the younger rowers.

“He was a fantastic club member and just a lovely, popular and cheerful young man who came from a wonderful family. We’re all devastated to hear what happened and our thoughts and prayers are with his family.”

Clonmel mayor Richie Molloy also expressed his condolences.

“The town is very shocked to hear that someone so young has died,” he told Independent.ie

“The stretch of road where it happened is fairly wide, but the weather in Clonmel was atrocious last night.

“My condolences and prayers are with his family during this very sad time,” he said.

The road at the scene remains closed to facilitate an examination of the area by Garda Forensic Collision Investigators.

Anyone with information is asked to contact Clonmel Garda Station on 052 6177640.

A girl of nine was killed and her young brother seriously injured yesterday when they were hit by a car while cycling.

Bridget Ward was pronounced dead at the scene of the Co Galway smash, which left the vehicle overturned on the R358 after the collision.

The two children were hit by the car close to their home between Ballinasloe and Ahascragh Road shortly before noon.

The boy, seven, was rushed to Portinucula Hospital with seriously injuries after the Easter Sunday crash.

Former Communications Minister Denis Naughten described his shock at the accident.

The Roscommon Galway TD wrote on Facebook: “What a terrible tragedy on Easter Sunday.

“Our thoughts and prayers are with those involved and their families at this time.”

A local person, who did not want to be named, said: “It’s horrific and savage and something they’ll never get over.

“The girl and the young boy were out on two little bikes and I think the car hit the wall and whatever else.” The family live in a Traveller housing accommodation facility between Ballinasloe and Ahascragh in the Creggan area.

“I’d say they weren’t 100 metres from their house. There would have been a couple of accidents there before.”

A Garda spokesman said the road was closed for a forensic examination and appealed for anyone with information to contact Ballinasloe station on 0909 631890.

Tributes were paid online to young Bridget last night with others wishing her brother, whose injuries are not believed to be life-threatening, well in his recovery.

One woman wrote: “RIP little angel... God bless the family and give them strength to carry on.”

Another said: “Beyond heartbreaking. Lord have mercy on that little girl RIP. And God hear our prayers for the little brother, a speedy and full recovery.”

A third added: “So sad your whole world turned upside down, sorry for all the families RIP. Little princess, please God your little brother will be OK.”

Banned driver who left student with 'catastrophic' brain injury jailed for eight years

Paul Connolly was under the influence of drugs and driving his young child to school when his car mounted the footpath.

A KILDARE MAN who left two pedestrians seriously injured when he drove onto a busy footpath before “calmly” leaving the scene has been given an eight and a half year sentence.

Paul Connolly (37) was under the influence of drugs and driving his young child to school when his car mounted the footpath, leaving one young law student with a “catastrophic” brain injury.

Connolly, of Cregg Court, Kilmeague, Robertstown, Co Kildare, has 215 previous convictions including 14 for dangerous driving and three for hit-and-runs. He admitted to taking cocaine and tablets the night before.

He was on a 25-year driving ban at the time and had been released from prison a month earlier.

Connolly pleaded guilty at Dublin Circuit Criminal Court to dangerous driving causing serious bodily harm to Mr Igoe and Mr Dhala at Coolmine Road, Coolmine on 1 May 2018.

He also pleaded guilty to driving under the influence of drugs; possession of cannabis; failing to remain at the scene; failing to offer assistance; failing to alert gardaí; as well as driving without insurance or a driving licence on the same occasion.

Judge Melanie Greally suspended the final 18 months of the sentence today, giving Connolly credit for his guilty plea, his remorse and his limited cooperation. She said she also took into account Connolly’s long-standing addiction issues.

At a previous hearing, the court heard how Connolly “undertook” a line of traffic stopped at a railway barrier, before suddenly swerving onto the pavement where he first hit Michael Igoe (54) and continued driving to hit student Francis Dhala (19), causing him “catastrophic” injuries.

Witnesses described him going back onto the road, doing a U-turn and driving “calmly” from the scene with a smashed windscreen. He was followed by a driving instructor who kept in touch with gardaí until they were able to intercept him.

‘Considerable distress’
The court heard Connolly told initially gardaí he thought he had hit “a bush.” He later said he had taken his eyes off the road for a second and didn’t know he had hit anyone.

Igoe sustained a badly-fractured ankle, bruising, torn shoulder muscles and concussion from bang to his head. He underwent surgery and the insertion of plates and screws in his ankle. He continues to have a limp.

Judge Greally noted that Igoe’s victim impact report was “very understated” but said he had no doubt experienced a significant deterioration in his health and well-being.

Dhala suffered a severe and traumatic brain injury and underwent multiple surgeries, spending over three months in hospital. He is currently spending weekdays at the National Rehabilitation Centre in Dún Laoghaire.

The court heard Dhala has done well since the accident but suffers ongoing issues such as cognitive defects and short-term memory problems. He has recently regained the ability to speak, eat and drink normally but is not expected to return to his full previous level of cognitive functioning.

Judge Greally said this had serious future consequences for Dhala who was studying law and attended court in a wheelchair with his family.

She wished both Igoe and Dhala a full recovery and said that she hoped Francis Dhala continues with his chosen career in law, adding “perhaps one day we will see him in this building.”
The judge also noted the serious trauma caused to Dhala’s family, particularly his sister Grace who was with him at the time, and the fact that the family was told multiple times that Francis was in danger of dying or of remaining in a vegetative state.

She said the family was in need of ongoing psychological support and had incurred hospital bills of over €100,000.

Defence counsel, Martin O’Rourke SC, handed in a letter of apology from Connolly and a psychological report into court.

He said Connolly admitted taking cocaine and self-medicating with street benzodiazepine as he had been on anti-depressants but could no longer afford them. He said his client had a difficult family background and started drinking as a 14-year-old, with most of his convictions being drink-related.

Judge Greally said there were “extreme’ aggravating factors in the case, including the “inherent danger” of passing a line of cars on the inside, then mounting a footpath exposing numerous pedestrians to danger, added to the fact that Connolly then accelerated along the path.

She also listed the fact that Connolly left the scene, was intoxicated at the time, and was driving his own daughter who was described by witnesses as in a state of “considerable distress”.

The eight-and-a-half-year sentence was backdated to 1 May last year. Connolly was ordered to be of good behaviour and abide by the supervision of the Probation Services for 18 months on his release.

Driver arrested in Cork after truck crashes into sea

A man has been arrested on suspicion of driving under the influence after the articulated truck he was driving crashed into the sea in the early hours of the morning.

Luckily, the tide was out at the time and the truck landed in just a few feet of water.

The driver and sole occupant of the car, a man in his fifties, managed to escape from his cab without injury.

Gardaí who were called to the scene near Youghal found him on the roadside and arrested him at the scene.

The incident occurred on the N25, about a kilometre on the Waterford side of Youghal Bridge, in the townland of Kinsale Beg at around 2am.

Gardaí from Dungarvan attended and found the articulated truck resting on its right-hand side in the water.

It is believed the truck had been driving towards Waterford, possibly on route to Rosslare ferry port, when the driver lost control.

The truck veered across the road and smashed through a stone wall into the sea.

The driver was arrested on suspicion of driving under the influence and he was taken to Dungarvan Garda Station.

Gardaí say investigations ongoing.

Traffic restrictions have been put in place along a section of the west-bound lane around the accident site and motorists have been advised to exercise caution in the area.

Arrangements are being made to have the truck removed from the water.

Motorist faces €1,000 fine after being caught watching Champions League match while driving

The driver was spotted in the Dublin area yesterday evening.

May 8th 2019

GARDAÍ IN DUBLIN have issued a penalty notice to a motorist who they caught driving while watching a soccer match on their mobile phone.

The individual was spotted by members of the Garda’s traffic division in north Dublin yesterday evening, when they were watching a match on a hands-free kit attached to their windscreen.

The Garda traffic unit’s Twitter account posted about the incident, suggesting that the individual was caught watching the Champions League semi-final between Liverpool and Barcelona.

“Champions League update….Motorist detected by DMR North Roads Policing Unit watching match on mobile phone while driving!” the account tweeted.

The tweet added that the motorist would be issued with a Fixed Charge Penalty Notice.

Under road safety laws which came into effect in 2014, drivers caught using their mobile phone to text or access other media face fines of up to €1,000, even if the device is in a hands-free kit.

Motorists who are convicted under the regulations must attend court, where the sum of the fine will be set by a judge.

29 arrests and €11k in drugs seized during rugby 7s tournament in Cork

Drugs worth an estimated €11,000 were seized and 29 people were arrested as part of a large garda operation mounted during the Kinsale 7s rugby tournament in Co Cork over the May Bank Holiday weekend.

Gardaí confirmed this morning that as part of the policing plan for the tournament, they deployed additional plainclothes members from the Divisional Drugs Unit as well as members from the Roads Policing Unit, in and around the town of Kinsale.

It resulted in the arrest of 29 people for incidents including alleged public order offences, suspected drink and drunk driving, and possession of suspected drugs.

Superintendent Brendan Fogarty, who is based in Bandon Garda Station, said more than 20,000 people come through Kinsale over the bank holiday weekend and the vast majority were "respectful and complied with gardaí and stewards".

"However, we had 60 detections for possession of suspected drugs, mostly cocaine, which amounted to approximately €11,000," he said.

This is an alarming amount of detections for drugs. Drugs have such a negative impact on so many lives and have no place in our communities.

"Six people also took the risk of getting behind the wheel with drugs or alcohol in their system.

"People who do this are putting themselves, our family, and our friends at risk by driving whilst intoxicated.

"If you are going out and want to have a few drinks, leave the car at home. Never ever drink and drive.”

When did the Irish term of 'Drunken Driving' turn in to the American term of 'Driving under the influence' (DUI) ?

Drunk would suggest under the influence of alcohol, I guess. As evident in the above reports cocaine abuse is probably a bigger issue these days. I believe it's commonly used by "professional" drivers to stay awake for longer shifts. In fact I've been offered cocaine several times by dealers who have told me "all" taxi drivers use it. I certainly don't and never will but that seems to tie in with drivers unions, including TTnH and ITDF, making representations on behalf of drug dealing (would be) double jobbing taxi drivers in court.

"All" would indeed be an over estimate, personally I would have known of 3 regular users, One reformed, One ate his gun and the other fella is a accident waiting to happen.

"will contestant No 3 come out....yes folks it Ken Cash!!

Naw ! Drugs were never my thing, actually I'm totally anti-Drugs, even prescription drugs. If I need a few pain killers like fer me ulcer last year then I will take them but apart from that I'm totally Drug free.

They don't hand these out Willy-Nilly to Drug addicts;

When did the Irish term of 'Drunken Driving' turn in to the American term of 'Driving under the influence' (DUI) ?
Most likely that they can now charge you with being drugged up too.
Easier to say Druving under the influence of
A: drink
B: drugs

Gardaí are appealing for witnesses after a motorcyclist was seriously injured in what investigators believe may have been a hit-and-run in Dublin city centre.

The incident happened on Amiens Street near the junction of Store Street at around 10:20pm last Thursday May 9th.

Gardaí said the motorcyclists, a 27-year-old man from the Fairview area, received serious injuries when he was struck by a car.

He was treated at the scene by emergency services before being removed to the Mater Hospital where he is receiving ongoing treatment for multiple injuries.

Investigators said they understand from their inquiries that his bike might have been hit from behind by a dark saloon-type car while travelling out of the city.

The car failed to remain at the scene.

This evening Gardaí issued an appeal to anyone who may have witnessed the incident to come forward. They are particularly interested in talking to any motorists who may have dash cam footage of the incident.

Anyone with information is asked to contact Store Street Garda Station.

Man in his 20s killed in hit and run in North Dublin last night

Gabija Gataveckaite
May 31 2019 7:09 AM

Gardaí are investigating after a man in his early 20s was killed in a hit and run in North Dublin late last night.
The pedestrian was struck down by an articulated lorry at approximately 12.20am on the Swords Road (N1) in Whitehall at the Collins Avenue Junction in the north of Dublin city last night.

He was then taken to the nearby Beaumont Hospital, where he later died. The road was closed overnight to facilitate a garda forensic investigation, and has since been re-opened.

The HGV vehicle did not stop at the incident and is reported to have been travelling from Whitehall, in the direction of Donnycarney in the northside of the city. The vehicle was white and was not carrying a trailer at the time.

Dublin City Councillor Artane-Whitehall Patricia Roe described the loss of the young man as 'absolutely horrific'.

"It's shocking and we're very upset for him and his famiily," she said.

"Because it's a hit and run, it makes it so much worse and I think the driver should go to the guards."

"I would like to extend my deepest sympathies to his family," she said.

The councillor explained that Swords Road is prone to heavy congestion.

"It's such a busy road here, there's traffic all day and night because of the airport and HGVs come in from the port," she added.

"This is the second busiest road in Ireland and myself and others campaigned to take HGVs off our roads after a young boy was killed at a crossing 20 years ago," she explained.

"We're so used to hearing ambulances, we hear them all the tie and we don't even notice them anymore," she concluded.

Gardaí have requested for anybody with information who was in the Collins Avenue Junction area at the time to contact them and are appealing to drivers who may have dash cam footage or information of the movements of the HGV believed to be involved in the incident.

Anyone with information is asked to contact Santry Garda Station on 01 666 4000, the Garda Confidential Line on 1800 666 111, or any Garda Station.

Nigerian charged:

A truck driver has been charged with dangerous driving causing the death of Gerard Whyte (21) in Whitehall in the early hours of Friday.
Prince Aibangbe (50), of Williams Way in Ongar, Dublin 15, was brought before Dublin District Court at the Criminal Courts of Justice yesterday where he was charged before Judge John Cheatle.

Garda David Jordan gave evidence that after the incident, images and video of the truck they were trying to trace were circulated in the media and came to the attention of Mr Aibangbe's employer, who in turn contacted gardai in Bray.

Gardai then met with Mr Aibangbe and his employer by arrangement at his place of employment in Blackchurch on the Naas Road.

Gardai seized the truck Mr Aibangbe had been driving and on Saturday night he was charged with dangerous driving causing death. The court heard that, when charged, Mr Aibangbe replied: "It happened yesterday, it was an accident."

Gardai objected to bail. Mr Aibangbe's solicitor Rory Staines said that his client is a father-of-eight, four of whom are in his native Nigeria and four are of school-going age and living with his former partner in Malahide.

"He has been driving trucks for 31 years and has never before been involved in an accident. He is two to three years with his current employer," said Mr Staines.

Disputed
Mr Aibangbe's former partner and family were in court. He has applied for Irish citizenship, which has not yet been granted.

Mr Staines said his client has indicated that he did not realise that he had been involved in an incident.

Gda Jordan said that Mr Aibangbe fled the scene, but this was disputed by Mr Staines.

Mr Staines said that if bail was not granted his client could spend some time in custody as it would take time to prepare the case, which was likely to be heard in a higher court on indictment.

He said his client has significant ties to this jurisdiction.

Judge Cheatle granted bail on condition that Mr Aibangbe provide his own bond of €5,000, with half to be lodged in cash.

He also has to sign on every day in Blanchardstown Garda Station, provide a telephone number for gardai, and surrender his passport. He was remanded in custody with consent to bail to appear in court at the CCJ again next Friday.

Mr Aibangbe, wearing a green hoodie and blue tracksuit bottoms, remained silent during the hearing.

Mr Whyte, who was from Ballymun, died after being rushed to Beaumont Hospital following the incident, which happened on the Swords Road, Whitehall, at the Collins Avenue junction shortly after midnight on Thursday night.

Mr Aibangbe failed to remain at the scene.

Garda forensic investigators examined the scene and made an appeal for information from the public.

They also issued a photograph and video footage of the truck they were searching for.

The truck was turning left from the Swords Road on to Collins Avenue when Mr Whyte was knocked down.

Two-year-old boy injured in Cork hit-and-run

Updated / Tuesday, 26 Mar 2019 11:26

A two-year-old boy has been seriously injured in a hit-and-run in Cork.

The incident happened at Castle Meadows off Skehard Road shortly before 4pm.

The boy was taken by ambulance to Cork University Hospital where his condition is understood to be serious.

Gardaí say the car involved failed to remain at the scene.

Gardaí have appealed for witnesses to contact them and are particularly appealing to motorists with dash cams who were driving in the Skehard Road and Castle Meadows area between 3.30pm and 4.30pm to contact them.
"Gardaí have arrested a juvenile in his late teens today in connection with a hit-and-run incident in Cork yesterday.

A toddler was left with serious injuries following the incident.
Zac Higgins, who is now in an induced coma in Temple Street Children's Hospital, incurred serious injuries when he ran onto the road while playing with a ball near Castle Meadows on the Skehard Road in Mahon in Cork city at about 4pm yesterday.

He was hit by a blue Mazda 6 which left the scene.
The teen is detained under section 4 of the Criminal Justice Act 1984 at The Bridewell (Cork) Garda station.
Gardaí believe there were a number of people in the car at the time of the incident and would appeal to the passengers to come forward.
Meanwhile, gardaí investigating the hit-and-run say that have recovered a blue saloon car believed to have been involved in his incident.
"The car was recovered approximately 1km from the scene of the collision," said a garda statement.
They added that the injured boy is described as critical but stable at Temple Street Children’s University Hospital in Dublin."

Some good news fer a change on this sombre topic;

Boy makes 'unbelievable recovery' after hit-and-run.
16 Jul 2019 17:46
The mother of a boy who was seriously injured in a hit-and-run in Cork last March says he has made an unbelievable recovery.
The incident happened at Castle Meadows off Skehard Road in Cork city shortly before 4pm on Monday 25 March.
Aishling Higgins says her son Zac, who turned three yesterday, can walk and talk again, and is forming four word sentences - which doctors did not expect.
She told RTÉ's News at One that her little boy's happy, smiley personality is there and that he "has a big smile on his face every day."
Ms Higgins said that Zac still struggles with daily tasks, saying that he has tremors in his hand and cannot hold a spoon.
Despite his progress, she said, there is always the worry that he will stop making improvements.
She added that because Zac has come on so well physically, there are concerns that he may suffer learning difficulties.
She explained that Zac must attend the National Rehabilitation Hospital in Dún Laoghaire soon where they will "work on every aspect of him."
"He's walking and they didn't think that he'd walk. He's started talking now. He can say kind of four word sentences which is amazing," she said.
"Now he still struggles with daily tasks but he smiles through the whole lot. But look, we have him and we're delighted that he's here, and we'll take every day as it comes."
Aishling said the day Zac was run over was the horrendous and the worst experience of their lives.
The two-year-old spent nearly eight weeks in Temple Street, where they discovered he had a very suffered a serious brain injury.
Aishling said half the parish has been invited to help Zac celebrate his birthday today, adding that he is looking forward to seeing Mickey Mouse and having lots of chocolate cake.
