Picked up a Barrister last night told me this story .His client was pissed and crashed his car and fell asleep in it .Gards came along and questioned the driver who told themhe parked the car into the wall .He was taken to the station and breathalized and charged with drunk driving .This week the case went to court and the Barrister represented the driver .After his client pleaded not guilty of drunk driving the Gards gave evidence .Then the Barrister went into action .He asked the Garda if his client was driving and the Gard said he was in control of the vehicle at the time of the accident .To which the Barrister asked what accident as far as he was aware his client parked the vehicle in that location which was not illigal .He then asked the Gard in what way was his client in control as the engine was turned off and the vehicle was parked .The gard said the driver was in possession of the keys to the vehicle that was his mistake and the Barrister pointed that out to him as the Car was keyless and was started by a fob .The Judge agreed with the Garda but the Barriter then introduced case law that clearly stated that being in controlof a vehicles starting apparatus was defined as possessing the keys there was no case law to cover the definition of a fob as a starting device .After giving the issue some considration the Judge agreed with the defence that the legal definition of being in control of the vehicle was not met in this case and as the driver had stated at the time of the accident he had parked it and no witnesses were available to say he crashed the judge accepted the defence and dismissed the charges .

Wont be long before some judge rules a fob is a key im sure some judge has already ruled but if you get the right judge and the right Barrister then if the judge is not aware of previous rulings he might rule in your favour .Money Talks .Smartarse lawers are paid to defend you against being found guilty of something that legally is not a crime .When drink driving laws were first introduced a fella was arrested in a pub carpark for drunk driving but he went to court and the publican turned up and said the carpark was private property and not a public place so the road traffic act did not apply .The driver won the cae .Then there was another case where somebody got knocked down in a carpark and the insurance company tried to say they were not liable as the accident took place on private property and the property owner should be liable not the motor insurer .The judge ruled that there was legal precident that covered carparks that although they were private property for the purpose of road traffic they were a public place as owners allowed shoppers use them before they actually made a purchase .I think a lot of these Barristers know in advance what way certain judges rule on certain issues .Just look at acident damages some people get two or three times more for whiplash depending on the judge you get .Law for the rich and conviction for the poor .The law is full of loopholes .A well known criminal defended himself on a murder charge a few years ago and when the prosecuting barrister rose to sum up the Criminal objected as there was a law that said as the defendent was not a skilled advocate he would be at a dissadvantage if a professional pracied the prosecution case and the judge agreec the prosecution were not allowed sum up their case to the jury .If I remember the Judgement I think he was found not guilty .

A courier I used to work with always kept a couple of cans of Guinness in his bag.If he was drink driving and got pulled in to be breathalysed he'd just skull a can in front of the copper.His thinking was the copper couldnt determine at what point he went over the limit.Proper dipso.I think he got banned for no insurance in the end.

A well known XTD hit a woman on the Navan Road and went into a relatives house and took drink he got away with drink driving but got a 7 year driving ban for leaving the scene of the accident .Judge knew exactly what was at play .

Not sure where the law stands on it these days, MfH. It was a well known trick, the hip flask would contain lucozade so you could knock it back with ease... particularly after a crash when you need to settle your nerves. The other one, which I think has been addressed, was to cut yourself and demand medical attention... no matter how small the cut they couldn't refuse and couldn't do anything else until that was attended to... there was some catch in patient privacy rules or something that meant the hospital couldn't cooperate with the Gardai in conducting/sharing/facilitating blood/piss tests.

There was a solicitor who shall remain nameless who advised certain gang members to sack their legal teams before summing up.....it was a well known delaying tactic....all evidence heard and all witnesses known............Paul Williams mentions it in several of his books. No idea if this loophole has since been closed off.............even if it has....it opens up others....
