Me Again
 
The story begins .Its a nice night the temperature is about 17 there is some Techno Emma Jai on the Cd when the throbbing base line gets interrupted by the familiar ping of the Mytaxi App summoning the driver to a pick up he accepts then the saga begins .
 
  Lets call the driver John although that might not be his real name but then again it might .Is it actually relevant what we call him ? Any how I digress or do I ?
 
Ok I have painted the picture of the scene now to the Drama .(isint this a nice way to get an E mail )
 
John the Driver nice fella just dosent stand for condescending nonsense from ANYBODY pulls up outside the address The customer details are Brian Mc Brian (not the actual name as I would not disclose a passengers private details )A tall good looking sultry girl appears at the door of the car looking vivacious and smelling of cheap perfume she whispers are you John ?John says are you Brian with a knowing glint that this Goddess about to enter his taxi is not Brian but she came out of the address  she says yes , she smiles and slides into the back of the car and John the ever efficient taxi driver presses the passenger on board icon inquires from THE passenger their desired location its only round the corner but work is work so John the ever efficient driver well, maybe not ever efficient he once failed to enter a correct fare immediately corrected his error and was scolded like a bold child any how I digress again .
 
When the Driver hit the passenger on board icon the screen showed Account job not Cash so John the absolutely charming driver represents the app provider and starts to bring the customer to the nearby destination .When JOLTED by the appearance of a big RED X ....Job Cancelled even though the passenger is sitting in the car .
 
Now to the serious bit .I or any driver pick up a passenger .You use to have an advisory ask customer their name but no adder advisory on what to do if the actual customer and the intended passenger are not one and the same .So I pick up a passenger looks like the app holder is hailing for a friend ,when he hails he does not observe that he is paying on account but after the passenger leaves he notices and corrects his mistake by cancelling the job .Now I have a problem I have a passenger on board I will get paid cash no problem but the issue and possibly a real legal issue with wider implications so think carefully and possibly take proper legal council .As soon as the app hailer cancels the job whos passenger is sitting in my car .Is that My personal passenger or a Mytaxi passenger .As soon as the hailer cancels I lose the ability to input any fare so the only conclusion I can consider is that that passenger is now my passenger as the original contract has been broken and that is an issue between mytaxi and the app user
 
I suppose an Email or  message to all app passengers telling them to be more carefull  when inputting payment method in future would be viewed by them as absolutely condescending .So the question is whos passenger is it ,what is the protocol to be followed and if the passenger entered my vehicle under the impression that the hailer was going to pay but then cancelled and they actually had no money who is liable to pay me .Is it the ehailer ?or is it Mytaxi as it is their customer or is it the customer who was duped by the icon on the app telling them that this fare was on Account .As I said there are implications for the definition  of whos passenger is on board .I do appreciate that the customer must be allowed cancel the job if their app is being misused but drivers must also be assured if they pick up third parties on behalf of an app user ,and after confirming that the passenger on board was the intended passenger they will not lose out if the job is cancelled in transit .The possibility of requiring the driver to ring the app holder if the person presenting is not the app holder would be cumbersome and intrusive on the app user .

Nah, I was talking with Ken over the weekend... his internet is playing up.

I didn't know that passengers can cancel after the driver presses POB, I don't think drivers can.

Can still be cancelled RC...by both driver and passenger...and you don't have to provide a 500 word written excuse as to why!!

So does anybody know .Whos passenger is in the car when you accept an Ehail .Is it your passenger or are you only a third party operator moving the goods on behalf of the distributor/dispatcher or are they your passengers .If so why would you pay a % of your earnings if the contract between you and the ehailer/distributor begins and ends when they enter the vehicle as your passenger .On the exchange of goods the contract is fulfilled between you and the distributor now you have a contract between you and the passenger ,remember when you accepted the ehail if you were not informed pre acceptance of the destination then no contract exists between you and the ehailer to deliver the passenger to a destination .

 The definition of whos passenger is on board goes to the fundamental business model of the % dispatcher .Can they actually take a % of your earnings from your passenger without your permission .

How? I couldn't find the cancel button when I tried a good while back so I ended up entering €1.00 cash payment to clear it, haven't looked for a button since.

Maybe i'm wrong....always thought that the (i) icon was still on the right hand side,i did have a guy cancel on me one night,well a couple of times after i'd pressed POB,east euro guy,doesn't want his burd to know he's goin to the casino at all hours in the mornin when she's back in their homeland!!

The red X disappears once you go POB so we as drivers would not be able to cancel.
It could be t prevent drivers cancelling all cash jobs after the passenger gets in the car.

Maybe they could introduce a thingy where if a customer cancels after driver went POB, the driver has to accept the cancellation and if the driver has to cancel then the customer needs to verify the cancellation. I know I've picked up the wrong passenger before outside of pubs and party venues.

  oops the issue and possibly a real legal issue with wider implications so think carefully and possibly take proper legal council . oops  .Whos passenger is it .Is it your passenger once you pick them up or is it Mytaxies .Unlike the UBER app that shows both pick up and drop off points as their contract with the Partner strange choice of word not Driver .You can be sure there is some legal significance in the use of the word Partner . My actual question im looking for clarification on is quite simple really .

 Once the Licenced Taxi Driver  picks up the passenger whos passenger is it ?.If its my passenger once the person enters my car then why do Mytaxi take a % of my earnings they should only be entitled to a pre agreed fixed fee or Pay Per Job for delivering that passenger to me .In reality if an app provides customers to you they might be entitled to the PUC at most for providing you the service but not a % of your earnings based on the randomness of the destination or duration of the journey .

  If the passenger is Mytaxis passenger then runners ,pukers would all be redeemable from Mytaxi and if you were assaulted by one of their Passengers would they be Liable to legal redress by the driver for any injuries or losses.

So part of the answer to who is liable for the fare might be included in this ...T&C   6.2 mytaxi shall not be liable, in contract, tort (including negligence) or for breach of statutory duty or in any other way for: (i) any economic losses (including loss of revenues, profits, contracts, data, business or anticipated savings); (ii) any loss of goodwill or reputation; (iii) any special or indirect or consequential losses; (iv) losses and/or damage not caused by its breach; (v) the actions or inactions of any passengers; (vi) the actions or inactions of other drivers; or (vii) failure to provide any services or to meet any of its obligations under these Terms and Conditions where such failure is due to events beyond mytaxi's control (for example a network failure) or failure of a third party service provider (e.g. a payment services provider)....OR DOES THIS ONLY APPLY TO THE PASSENGER ?
