A taxi driver who sexually assaulted a late night passenger after she had passed out drunk in his car, will be sentenced next month.
The victim told gardaí that she woke up to find Gerard Gunnery (60) with his hand inside her and masturbating himself. She said he then became aggressive and threw her out of the car, leaving her in a heap on the side of the road.
Lawyers for Gunnery asked Judge Karen O'Connor to not define him for these “ten minutes of a life” which was otherwise “all of good”. Dominic McGinn SC, defending, said his client's actions that night were “completely out of character”. He handed in testimonials describing Gunnery as a hard working, “good man” with a “kind heart”.
Gunnery of Ellenfield Road, Whitehall, Dublin pleaded guilty at Dublin Circuit Criminal Court to sexual assault of the woman at place in Dublin city on December 23, 2017. After a sentence hearing today Judge O'Connor remanded Gunnery into custody to December 11th next for imposition of sentence.
During the hearing the victim addressed the court and said that a regular girls’ night out in town turned into a nightmare when she woke up in the front seat of the taxi parked outside her home. Neighbours later told gardaí they heard a woman shouting “get off me” and “stop, don't touch me” and saw the driver pulling the woman out of the taxi. She was screaming that her leg was stuck under the taxi and he came out and “threw her out of the way”. She was found on the ground crying and screaming. The court heard she suffered bruising to her elbows, kneecaps and her jaw.
Gunnery made a statement to gardaí claiming that the woman had told him to “go for it” and that he wouldn't have touched her if she hadn't said that. “I am really sorry. She was drunk. I was sober,” he told gardaí.
In her victim impact statement the woman told Gunnery that “you took advantage of me when you should have taken me home”. She said she suffered crippling guilt and shame and entertained thoughts like “I drank too much, my skirt was too short, my knee high boots were too inviting”. She feared that her attacker was still out driving a taxi and knew whereabouts she lived and said she still suffers flashbacks and becomes upset if she sees a silver coloured taxi.
Judge O'Connor told the woman that “this was not your fault” and told her she had shown great strength on the night and since. “I sincerely hope you get to a point where you can put this behind you,” she said.

Gerry was the taxi driver who picked up the passenger who was travelling in the taxi that crashed into me in 2010.
The collision happened at Blackhall place. After Gerry dropped the guy off at the Crown Plaza in Santry he returned to see how I was.
I often see his family sitting in the garden during the summer.

Driving Licence is Issued by the Gards unlike his vehicle licence .The taxi act 2012 laid out certain offences which would deny you a Taxi licence but nothing to Deny you a SPSV driving Licence .So if you are warned off from owning a Taxi licence it is still possible to rent one ?

No the NTA taxithingey issue the Plates and renew them Legislation sets out what convictions disqualify you from having a Taxi Licence but the Drivers licence is issued every 5 years by an Garda .I know when you apply for your original SPSV the Gards give you a coat of looking over to make sure you are a proper person to hold a licence but I dont know if they ever reaffirm your crediability .There could be two different standards that apply here .If this Fella had signaled that he was going to plead guilty back in 2017 then the taxithingey probably had the power under the taxi act to suspend the issue of a taxi licence .Where the Garda did not have any such power as he had not been found guilty and to suspend his licence could be seen as prejudging the issue and compromise the prosecution .

Just cos he was pleading guilty means nothing until the court date...he has the right to change his plea also so the NTA or the Gardai couldn't take any action until a judge makes a ruling in the case.

Now Hal Why did it take 3 years before he was arraigned .He was obviously caught almost immediately a Big yellow number on the Roof is a real giveaway . The taxi thingey are a body corporate a Limited Company .What would happen if they reissued a licence if they were aware that this incident had taken place and he did it again ? I remember somebody on here posting about the Pakistani driver in Lucan who was accused of assaulting female passengers applying to have his licence returned as he was not yet convicted .Its probably Taxithingey Policy to suspend Taxi licences or renewals to persons deemed by them to be non compliant .By doing this they cover their arse and leave it up to the Courts to reinstate licences .We see how arse covering works with the Wollf judicial Shitfest .Government dont want to make the decision they want the Chief Justice to make the decision and he fucked the issue back to the Government quicker than he would throw away a hot steaming Shit.
The real issue is how does it take 3 years to come to court .Gretty Hogan was caught two weeks ago robbing a bottle of Nivea hand Lotion she was fined 120 euro on Friday .

I spoke to a local who was saying that neighbours were up in arms and were considering contacting the NTA.
He had pleaded guilty to the offence in February 2020 yet continued to drive up until the licence expiration in 05/11/2020.

An Garda Siochana are responsible for revoking licences. They would have been better served walking as far as the carriage office.

Did DM not say he was renting? His plate expired, well lapsed, on 05/11/2020. Interestingly his SPSVDL was due to expire on 14/11/2022 but seems to have been revoked i.e. the badge number returns no record on the TfI app.

^ He was most recently assigned to his own plate - 30235 - although he was briefly assigned to one of Stuart Kessie's - 41660 - previously. Maybe his own motor was off the road for a while and he couldn't afford the repairs or something.

Plate history suggests his motor fell victim to the 15 year rule in July '19 but was replaced with a once new wankbox in Nov '19. Presumably he had to rent from Stuart to save up for the newish motor. Getting caught didn't seem to deter his investment.

Tony Cascarino has opened up about his fears of developing a brain disease such as dementia or Alzheimer's in the future.
The Italia 90 hero reckons that he has a high risk of developing dementia due to his family history as well as the impact of heading the ball during his famous career.
The former Republic of Ireland star, 58, is concerned after noticing small trends in his recent years that suggest he could develop the disease.
"My dad has got dementia and it's on his side of the family, his brother had it and his sister had it. My mum's side - her sister's had dementia," Cascarino said on Claire Byrne Live.
"I've headed the ball an awful lot and I do know the numbers are pretty horrific in regards to footballers playing (are) three and a half times more likely to get dementia.
"Plus I've had brain surgery, which can start off the process of the slow death of cells in the brain".

He continued: "Do I feel like when I was the age of 45? The answer is absolutely not.
"I do feel myself changing and I feel my brain, I'm finding it way more difficult to take memories - especially short term - to hold them and I'm making mistakes.
"It does make the alarm bells in my head (go off), and I think, 'Is there something more sinister going on?'.
"I do have my concerns".
Describing the devastating impact the disease can have on families, Cascarino admitted that he would not be adverse to assessing his options if he did develop dementia.
And he claimed he has had conversations with family members around the option of euthanasia if he develops the disease.
"I've chatted to my wife, I've had chats with family members and said, 'You know what, if that's me I don't want to be around.
"I don't want to be around being that person that needs caring, and I think many people think like that".
Cascarino also touched on the late Jack Charlton, revealing that he and his fellow Ireland players noticed signs that indicated the legendary Irish manager could develop the disease.
Charlton died in July after suffering from lymphoma and dementia in his latter years.
"It was quite strange, Jack (would have been) the same age as I am now - in his mid-50's and getting close to 60.
"We noticed many things along the way, certainly with his confusion, sometimes misplacing words and confusion over names as he'd get many names wrong including myself.
"He called me the 'ice cream man' jokingly, but he always clicked his fingers to say to me, 'Cas..'".

Apparently some studies have shown that excessive wanking when young may have links to prostate cancer, whereas for 50+s it may prevent prostate cancer. Your safe to carry on Hal as long as you were moderate in your youth. Two types of liar. One who says that he never wanked , and the other who said that he gave it up.
