A story that dosent feature Big Dommo
« on: October 23, 2021, 05:47:02 pm »
Big Dommos mate !Was left a Taxi licence by a neighbour but not the car .No there is an issue .He waited a few weeks before approaching the widow about the licence .She said she cannot do anything about it as the will is in probate .Now whats the story ,which takes precident the transfer from the taxithingey or the actual will .If there was an issue over the will and probate was denied for a while could the Taxi licence expire at the moment the licence is suspended ,is the time still running before it lapses .Would you need a copy of the death cert to prove to the taxithingey that the licencee is actualy dead .I only came back to ask this question Dommos mate dosent want to cause a shitstorm until he knows what the answer is .Has anybody heard of somebody being left a licence without the vehicle and how does the transfer work .Dommos mate was hoping to apply for the electric grant he has a SPSV he use to be a renter .

https://www.nationaltransport.ie/wp-content/uploads/2019/02/Form_S15N_application_to_nominate_a_person_in_the_event_of_death.pdf

Quote
Once your application has been processed, the Authority will send you a
Nomination Certificate confirming that your nomination is valid
. Keep this safe
and tell whoever will be looking after your affairs after your death about it.
For more information: see Information Guide G15: Handing on / taking over a
vehicle licence on the Authority’s website.

You get a cert that your mate digs out of the wardrobe after you die?

https://www.nationaltransport.ie/wp-content/uploads/2021/09/Information_guide_G15.pdf

Quote
When can you apply?
After the person who nominated you dies, you can then apply to take
up the vehicle licence, either in your own right or as the
representative of a company nominated by the deceased person, as
appropriate. You must make the application within nine months of the
death of the person who nominated you, and the vehicle licence must
not have expired more than twelve months previously.

The steps to follow
Making an application is relatively straightforward, but there are a
number of steps you need to go through and some requirements you
need to meet.
1. You will need to download and fill in the Section 15 Assignment
Form – S15A – for details on filling this form, see below.
2. NTA will contact you to arrange an inspection of the car you intend
to use. The car must meet all the licensing regulations and
standards – see the Vehicle Requirements panel below.

You've 9 months after the death to finish to apply and the licence must not be expired more than 12 months.

Info guide/summary of the process.

Any more questions and you'll need a man with a wig  :o

Interesting Watty .I got that cert off the taxithingey and just threw in in with my tax returns ,seems its a sort of legal transfer .Still lets the widow or solicitor decide if they hand it over or not so I suppose what yer one said about probate is correct .

I sent him that link .It seems that the widow thinks the licence is worth a fortune and wants to get advice ,she didnt know her husband had left it .He hasent been well for a while and lapsed his licence last year so it is still within the timeframe and I think the taxi thingey have added time you can lapse your plate due to covid .I suppose if somebody had left you the licence they should hand you the transfer while they are still alive .But would you still need a copy of the death cert to prove it as that would stop us selling on the plate under the pretense we were dead .

The problem (if there is one) is there was a will (if there was one)  drawn up. Did D`s mate get confirmation from NTA the transfer on death form was lodged ? If so, tell him to go into Public Office of Probate Office with confirmation and enquire about status of any will lodged or if intestate, provide the confirmation from NTA as claim on the intestate estate.  He might need to get an Affidavit of Attesting Witness or Plight of Condition  drawn up by a brief to lodge with Probate Office. It`s a while since I processed wills for Peart`s but the Public Office will help Dommo`s mate .

I just passed on your advice .Its a son in Law that got the licence .Think there could be other issues  .I think there should be better advice on transfers from the Taxithingey and exactly what the legal status of the transfer is .Does the ownership of the Licence pass to you or can the transfer be challenged ?Did the taxithingey say that a Licence has no value so is it a transfer of Property ?
