6 euro fare from the shops to the Garda Station .Lad was up in court this morning getting his car back .He is on a 1 year driving ban and the Gards stopped him took the car off of him .He went to court to get his car back and got it ,Because when he got his ban the judge said his licence was to be endorsed .He has a Privisional licence and it seems only full licences can be endorsed .He argued that if that was correct then he could continue to drive on a provisional until he passed his test to facilitate the endorsement .Sounds far fetched if thats true then Provisional driving licence holders cannot be banned if their licence is to be endorsed as they would have no way of getting a licence to endorse so the sentence is un enforceable ??

Wouldn't surprise me.  Weren't people avoiding endorsements/bans simply by not bringing their licence to court?  The Guards/officials never chased it.

If he turned up unaccompanied to collect the car with a Learner Permit An Garda Siochana would sieze it again as soon as he drove out of the pound regardless of any driving ban. A Learner Permit holder must be accompanied by a driver who has held a full licence for at least two years these days, erm.

If he was accompanied by a (fully) licensed driver said fully licensed driver could drive the car from the pound provided he produced adequate insurance cover i.e. it was the driver who was banned not the car.
