In fact, I got my renewal notice from Taxifair before Christmas. Under the paragraph "If any of the following responses are incorrect, there is ever any change in this information during the course of your policy, or you are in any doubt, you must tell us" the only relevant question is "Have you or any person who may drive more than 6 penalty points", the given answer being "No" as I don't collect penalty points.
So, in my case it's there in black and white that I'd have to accumulate more than 6 points before informing them. I think you'd have to be extremely reckless to achieve that, particularly bearing in mind that you can very significantly drag out the actual awarding of the points by waiting until you get the court summons at which point you are presented with the final option to avoid the court case and the risk of a higher points award by paying the (increased) fixed penalty.
As an aside, I filled in the form on the new BJPs www site on Monday and got no reply as of this afternoon so gave them a ring. He asked a few questions and quickly advised that the price I got from FBD via Taxifair (€1,451.59 with full NCD protection and all the bells and whistles) was as good as it gets. I wonder if they're intentionally winding down their PSV business?
