A pregnant woman is to be sentenced later this month for her role in hijacking a taxi and assaulting the driver in the Phoenix Park last summer.
Dublin Circuit Criminal Court heard that the victim has not driven a taxi since the incident, during which he was choked with a seat-belt and almost lost consciousness.

Gillian Byrne (38) of St Vincent de Paul Hostel, Sean McDermott Street, Dublin 1, pleaded guilty to the unlawful seizure of a vehicle and assault causing harm on July 26, 2023.

A co-accused woman is to be sentenced next week for the same offences and the additional charge of falsely imprisoning the taxi-driver.

At a hearing today, the court heard that Byrne rang 999 immediately afterwards to tell gardaí about the offence and her role in it.

A prosecuting garda agreed with Mark Lynam SC, defending, that Byrne had a “passive role” in the hijacking and the assault and had not known they were about to happen.

Counsel said Byrne did not know her co-accused until that morning and had been of the understanding that they were going to the park to collect a car.

Mr Lynam said his client was very remorseful and horrified by what had happened to the taxi-driver, whom she described as a “lovely man”.

The prosecuting garda told Marc Murphy BL, prosecuting, that the taxi-driver picked up Byrne and the other woman outside the Gresham Hotel on O’Connell Street at 5.40am on the day in question.

The women got into the back of the taxi and directed the driver, who was aged in his late 60s or early 70s, towards the Phoenix Park.

The driver later told gardaí he got “a bad feeling” after the women directed him towards the magazine fort in the park and he turned the car around.

The women started shouting at him to stop and he felt one of them put something around his neck.

It is the State’s case that the co-accused put a seatbelt around the driver’s neck.

The man told gardaí he pressed the footbrake and was starting to lose consciousness, but that he managed to stumble out of the car in a disorientated state.

He said he was then either punched or kicked in the face by the co-accused and fell to the ground.

The victim said he began to shout for help and saw the women starting to panic.

A passerby came to his assistance as did a member of the gardaí who happened to be in the area.

The man was taken by ambulance to hospital suffering cuts and bruises and minor injuries.

The taxi was found later by gardaí in a different part of Dublin.

The injured party did not wish to make a victim impact statement and told gardaí it would be too traumatic for him to attend court.

Byrne phoned 999 of her own volition and was arrested, making full admissions and expressing remorse.

She has 12 previous convictions, of which one also involved the unlawful seizure of a vehicle, for which she got a four-year-suspended sentence.

Mr Lynam said Byrne also had a passive role in the previous hijacking and had been in a relationship with a co-accused man at the time.

Counsel said Byrne had requested to be sentenced separately to her co-accused in this case, and that she had allegedly been assaulted by associates of the other woman close to the court.

She is due her baby in April, the court heard.

Counsel said Byrne has a history of drug abuse but is doing quite well at the moment, according to reports from Coolmine Therapeutic Community and other services.

A psychological report outlined that Byrne has borderline cognitive functioning and was described as easily led and eager to please.

The court heard she has had a lot of trauma in her life and would benefit from residential treatment to bolster the work she is doing to tackle her addiction issues.

Byrne wrote a letter to the court expressing her horror at what happened and another letter of apology to the victim himself.

Her current partner also wrote to the court describing her as loving, caring and empathetic.

Counsel said there was an “ongoing threat” to Byrne and that it was “not a good situation” for her to be going into prison, especially while she is expecting a baby.

Judge Orla Crowe adjourned the case for finalisation on October 24.

The co-accused woman is due to be sentenced next Tuesday, October 15.

A retired couple from Cork who were on a short break in Sligo had their car hijacked by a drug addict couple from Dublin who drove off at speed and were later pursued by Gardaí.
The car was eventually crashed into a wall after being driven the wrong way up a one way street in Carrick-on-Shannon and the couple were arrested after they took off running through fields.

The retired couple were not present at Sligo Circuit Court last where 31-year-old mother of three Gillian Byrne of Cloonmore Park, Jobstown, Tallaght, appeared for sentencing having previously pleaded guilty to unlawfully seizing a car by force belonging to a Mrs Rebecca Chambers at Dunnes Stores car park, Adelaide Street on Monday May 8th 2017.

Judge Keenan Johnson expressed the court's sympathy to the victims and said he wished to advise them that "Sligo is not that type of town."

At the same court, Derek Nolan also of Coolmore Park, who was described as Byrne's former partner, pleaded guilty to seizing the car and dangerous driving at Townspark, Carrick-on-Shannon. A count of criminal damage was taken into consideration.

He was remanded on bail for sentencing on May 29th next. He spent nine months in custody following the offence on remand and when he was released he underwent a drug treatment programme his defending barrister, Mr Patrick Jackson told Judge Johnson.

Outlining the case, Ms Dara Foynes BL (prosecuting) with State Solicitor Ms Elisa McHugh, said the retired couple were not in court but had prepared victim impact statements.

They had driven up from Cork on May 6th with the intention of staying three nights at the Radisson Blu hotel.

They spent time sightseeing and on the 8th they drove their 2012 VW Golf into Sligo and into the car park of Dunnes Stores at Adelaide Street around 6.15pm.

Rebecca Chambers was driving. She could not remember much of the incident other than her telling her husband to stand back and being afraid for him. She recalled the car being taken with the keys in it.

"The rest is a blank," said Ms Foynes.

Mrs Chambers remembered being at Sligo University Hospital and being told there what had happened.

Mrs Chamber's husband recalled being at the back of the car and hearing his wife say "you are not getting in the car, I won't allow you." He then saw his wife struggling with a man.

Mr Chambers got into the car and by that stage Nolan was in the driver's seat and he was shouting at him to get out.

Nolan told him that if he didn't get out he'd shoot him and then pushed him out of the car.

Byrne also ushered Mr Chambers from the car before jumping in herself.

The car then took off at high speed with no regard for the safety of pedestrians or other traffic, said Ms Foynes. The incident happened very quickly, she added.

The Chambers said it had been a terrifying experience and they spent a night in hospital. There was concern for Mr Chambers as he had a heart condition.

The stolen Golf was spotted in Ballinafad and was pursued by Gardaí but it failed to stop. It continued at high speed on to Carrick-on-Shannon and Gardaí took the decision to close the road because of the manner of driving.

The front tyre of the car was punctured by Gardaí in a bid to stop it but it continued on and drove the wrong way along a one way street before crashing into a wall outside the town.

The occupants then took off running through fields but were caught by Gardaí.

Byrne gave her correct name while Nolan gave a false one.

Garda Danny Grimes said the accused and Nolan were brought to Ballymote Garda Station for interview.

The Garda agreed that Byrne complained about the manner of her arrest, the Garda who arrested her and with being handcuffed.

She told Gardaí that she was detoxing off heroin and hadn't been eating in a few days. She blamed her ex partner for her addiction to heroin.

The Garda agreed that at the original interview Byrne offered no assistance.

She had convictions under the Road Traffic Act including one for driving without insurance.

The Chambers lost their car at a cost of €8,000.

In her victim impact statement, Mrs Chambers said she felt vulnerable at times. They had planned to stay in Sligo for a week but went home after two days as they didn't feel strong enough to stay.

Mr Chambers said he got a fair fright and shock and took the threat made to him seriously.

Is there a bit of Keyser Söze going on here?   She keeps hijacking cars but because she's stupid, it's the fault of the other person?
