I saw a taxi mill a woman off her bike on O'Connell St at 02.16.
She ran the red light.


On Saturday night I dropped an old guy to Portmarnock who rammed into a Prius on the Swords Road.

The driver might still be in trouble.  There was a case a few years back down North Strand way where a cyclist ran a red light and ended up with brain damage after a taxi hit him.  Cyclist was totally in the wrong but he still got 100,000's in compo.  The judge ruled that even though the taxi driver was starting from a stop position and he had the green light, it was still somehow his fault!  Taxi driver had dash cam and witnesses but he still lost.  It's not obvious from the news link below if the taxi was even first in the queue.

Mr Byrne said the speed at the point of impact was in the region of 33km/h.  According to witness statements, Mr Byrne said it would appear the driver would have no chance to see the cyclist and dash cam footage from the car was also available.

No right of way is absolute. A green light means go if it's safe to do so.
If it doesn't have a roof sign and door stickers it's not a taxi.

What does a red light mean?

20% blame cost the taxi driver €190,000!  The link above is the 1st one I found but I remember reading a longer article from that time.  Short of having a man with a flag walking in front of the taxi, there was nothing he could have done to avoid the kamikaze cyclist imho.

Leaving aside the taxi element, it struck me as one of those cases one reads about from time to time where the 'legal system' seems to ignore the law and give 'the poor sod' a few bucks to help him along the way.

You must stop at a red light, Watty.... but that doesn't mean you must go at a green light.

It's interesting that the picture in that report shows the traffic signal as being green for "Bus". Whether that's relevant or not it does raise certain concerns. Often folk who break lights act on anticipation. Just to extrapolate using the "Bus" assumption in the circumstances particular to the accident in question as an example. The "Bus" light is only visible from one side and is, obviously, specific to traffic in the bus lane hence the cyclist could travel on his route every day and not be aware of the existence of that signal so has it in his head that there's a significant delay between his light going red and the opposing light going green, a delay he perhaps concluded he could safely exploit. In any event, it's probably fair to conclude that he didn't intentionally cycle into the path of an accelerating vehicle. Whether or not he was or should have been visible to the driver is another matter altogether. Was it dark? What was the weather like? Was he wearing dark clothing? Was his bicycle fitted with lights as required by law? etc, etc...
If it doesn't have a roof sign and door stickers it's not a taxi.

@RC - if memory serves, it was East Wall Road heading north towards Poplar Row (Annesley Bridge/Fairview park would be on your right)

@TD42 - E&OE... it was the perfect freak accident.  The driver did look around but the A-frame in his taxi blocked his view of the cyclist whose speed matched the taxi (I'm guessing).

Fact remains the cyclist 'started it' by breaking the red light.  If it were a 2-car collision at 33km/hr, we wouldn't be having this conversation.

That's a reasonably "open" junction i.e. with relatively good visibility... although if the cyclist came from the left (Ballybough side) and the taxi was in the bus lane the driver's sight of the approaching cyclist would be somewhat restricted.

Given that cyclists have no insurance I guess even an emergency stop in a situation like that could give rise to fucking up your no claims bonus / loading should a passenger suffer whiplash?

Yeah, like I said, the story stuck in my mind from the longer article because imho the driver couldn't have done anymore.  And he had dashcam AND witnesses but the 20% blame still cost him €190,000!

Well, cost his insurer. Given that it took over 3 years to resolve and the insurance company were contesting liability he mightn't have been too heavily "loaded" in the interim but the cunts always get it back one way or another. Dashcams don't have the same access to peripheral vision as the human head but I guess it was always clear that the cyclist was responsible for the vast majority of factors causing the collision. He has a brand new (well 2023) ID4 now so not short a few bob anyway!

Glad to see he got back on his feet.  Though buying an almost silent vehicle might not have been his best option.  That's tempting fate  :P
