Just one of the several thousand people who arrived in Ireland without a valid travel document in recent years faced related criminal charges.
More than 4,200 people arrived at immigration control in Dublin Airport last year with no travel documentation, indicating they had destroyed or lost it before reaching immigration control. The majority of these claimed asylum.
Under the Immigration Act 2004 it is an offence, punishable by up to 12 months in prison or a €3,000 fine, for an adult to land in the State without a valid travel document.
According to figures obtained by The Irish Times, just one person has been charged with this offence since 2019. They faced a single charge in 2019 and no conviction was recorded.

Another person was charged in 2021 with attempting to leave the country without showing a valid travel document to immigration officers. No conviction was recorded in that case either.
The figures were released by the Court Service, which warned some additional cases may have been brought but not recorded properly in court records.
The issue of foreign nationals destroying or losing passports when entering the State has attracted significant controversy in recent months, as Ireland deals with record numbers of asylum seekers entering the country.
Security sources, immigration experts and the Department of Justice say there are various reasons someone might not be charged for failing to produce a travel document.
A Department of Justice spokesman said that in some cases people without travel documents are immediately “returned to their country of origin as soon as is practicable. In these circumstances, the question of prosecution does not arise”. He said prosecution decisions are a matter for the Garda and Director of Public Prosecutions.
A Garda source working in immigration pointed to a provision in the Act stating a person may avoid prosecution if they can prove they had “reasonable cause” for not having a travel document.
They also said humanitarian concerns and the administrative burden of prosecuting so many people for a relatively minor offence may play a role in the low number of charges.
Stephen Kirwan, a solicitor with KOD Lyons specialising in immigration and asylum, said it is a complex area of law. He said that the Geneva Convention on the Status of Refugees does not require asylum seekers to have travel documentation when presenting at a border.

Human traffickers
Additionally, some asylum seekers are accompanied into the country by human traffickers or “agents” who provide them with false travel documents and take them back before the person disembarks the aircraft.
Not having a travel document when reaching immigration “can be an indicator of genuine persecution”, Mr Kirwan said. “It can also absolutely be an indication of someone coming into the country on a false document, destroying that document and trying to enter the country for nefarious purposes. I think the reality is somewhere in between.”
Mr Kirwan said these aspects “assumedly” form part of the authorities’ decision-making when considering whether to bring charges or not.
He said that in recent months the Department of Justice’s Border Management Unit has stepped up checks to prevent people losing or destroying passports between disembarkation and border control. This includes checking passports while people are still on the aircraft.
Separate figures show there was a higher rate of prosecutions of foreign nationals who fail to produce documents showing their identity and nationality while in the State.
There have been 388 such charges since 2019. Only 16 per cent of these cases resulted in a conviction, however.

As SF repeatedly stress we are a long way from pulling our weight as EU members when it comes to facilitating immigrants and we are heavily reliant on first generation immigrants to drive, clean, build, etc, etc hence it makes little sense to punish those who choose to come to our shores.

Our education system has probably evolved somewhat from what you may recall. Classrooms don't have a thick table for the kids that'll find their way into semi-state apprenticeships by the age of 15. They're called dyslexic or illiterate or BLTGWQUIX++ or whatever these days and sent to college in pursuit of shirt and tie wearing occupations... with considerable success, to be fair. I'd say you could offer Irish educated kids €500/hour to drive a cab and they'd tell yo to insert it into your posterior, they simply don't want neck down jobs.

Maybe, as RC hints at, young folk nowadays don't finish their education until their mid-20's and, with so many living at home, they don't develop any urgency for self-responsibility? A few decades ago, there was a good chance you were married with a kid, a mortgage & a job for life by the time you were 25 y.o. Nowadays, you're probably starting your first job at 25 as a non-paid intern with some company that won't offer you a job for life. Your girlfriend, if you have one, is probably in Asia doing a lap of the world to 'discover herself'. If someone mentioned kids or a house to the 25 y.o., they'd probably laugh in your face at the absurdity of the notion.

I think that the Irish went to America ,Brit land ,Canada and were sent to the Aus ,as desperate people who would do most corrupt things to survive in countries where the Irish Catholic Immigrants were hated.They survived through corruption and hard work. The U.S and others are big Countries and could absorb and needed bodies at the time. On the other hand Ireland is a small Country that cannot absorb the policy of taking in every Tom Dick and Harry and bussing them to Holliday Hotels with benefits forever? Octy, I know you have claimed to have poor comprehension skills but that's no excuse for pure delusion. I haven't once said that the Irish are lazy and, in fact, I haven't identified any particular race, Irish or otherwise. What I have said is that "Irish educated" kids don't want menial jobs. A significant proportion of Irish educated kids are (second generation) immigrants these days. In fact, arguably it's the immigrants' kids who get the best education as resources are heavily biased towards Educate Together, without whom the immigrants' kids would have to go to white schools and all the kids would get... well... educated together. What I'm saying is actually very simple and I'd respectfully suggest well within your comprehension capabilities. Folk don't go to university to learn how to drive or empty bins or clean gaffs, etc, etc... It doesn't matter how much you'd offer them to perform such tasks it's not what they want to do so as long as there's plenty of jobs that fit what they want to do they ain't gonna do what they don't want to do or what they feel over-qualified to do.
Further contrary to your implied lack of comprehension I have explained the economic situation to you... again in sufficiently simple terms. The economy is at full employment. What that means is that anyone who wants a job has one i.e. there's nobody waiting for wage increases to pursue menial occupations.

Not at all. It's a great little country, one that I'm happy and proud to share with any others who may choose to join us. Part of what makes it such a great little country is our ability to recognise and act upon our limitations whether that involves looking to (second generation) migrants (Pearse, Devil Era, Varadkar, etc, etc) for leadership or farming out the regulatory bits. Maybe not a degree (which is a Level 8 qualification nowadays) but some sort of course. You can do a course in almost anything nowadays. Wanna work on a building site - you'll need a SafePass. Wanna work in a warehouse, you'll need a manual handling course. Wanna work as a cleaner, there's probably a course for that too. Good thing for the Govt statistics as well is that they 'disappear' off the dole numbers as they're in active education!
