Garda squad on the way to combat road insurance fraud - judge

Rioad crash fraudsters have been warned by a judge of An Garda Síochána's intention to set up a special squad to investigate them.
The warning was issued by Judge Jacqueline Linnane in the Circuit Civil Court, after she threw out three claims for a total of €180,000 damages.

These were for personal injuries allegedly suffered by three men in a rear-ending incident on July 7, 2016.

Judge Linnane said the court had not been convinced Piotr Czaderski, Eugeniusz Perkowski and Maciej Kostka had suffered any injury in the low-impact collision on Crumlin Road, Dublin.

The judge told barrister Conor Kearney, counsel for motorist Aisling Kelly, The Ward, Co Dublin, and Aviva Insurance, there was low impact contact between Ms Kelly's car and the Volkswagen Passat of Czaderski.

However, she believed he and his work colleagues, Perkowski and Kostka, together had planned taking proceedings against Ms Kelly.

Judge Linnane, referring to the proposed new fraud squad, said the court claims had been orchestrated by Czaderski.

The court heard Czaderski (38) of The Moyle, Prospect Hill, Finglas Road, Dublin; Perkowski (67), Addison Road, Dublin 3 and Kostka (25) The Plaza, Coultry Road, Ballymun, Dublin, were fellow workers in a waste collection company.

Mr Kearney, who appeared with BLM Solicitors, said the three men, and a fourth man who had not gone through with a claim, worked for Panda Waste and had gone to work directly after the collision.

He put it to each of them that they had afterwards got together and decided to bring claims. According to medical reports all of them had reported pain in their upper back and neck.

Counsel said Ms Kelly's 78-year-old mother had been in her daughter's car at the time and had not been injured. He told Judge Linnane he was prepared to call her to give evidence, but the judge said it would not be necessary.

Following the dismissal of all three €60,000 claims, Rob Smyth, head of fraud at Aviva said it welcomed the decision.

"As part of our zero tolerance strategy to fraud, we intend to take all necessary steps to recover all our costs and will also make a formal criminal complaint," he said.

Who pays their costs,were costs awarded against them....they should be locked up and all their assets seized until it's recouped

What about the cost of policing, feeding and watering them while locked up? ... and who's going to empty my bins while they're doing porridge?

Aviva's man said they'll take all necessary steps to recover costs. Notwithstanding an appeal, I bet they wished they'd accepted the PIAB assessment, assuming there was such an assessment.

Your obviously not interested in recycling,
 Once you start recycling it becomes just part of every day Life,
 Wash all your cans, jars  and milk bottles,  put them into the recycling bag, bring down down to recycling centre once a week, easy peasy.
Not such a chore,
 Lazy fukks just open the lid of the bin
 Throw all the shit in and don't give a fuck where it ends up.
 Take responsibility for your own shit .

My kids went to schools that drove the green ethos..like many ifcnot all schools...they're the two laziest fuks when it comes to recycling,i've had more rows,pulling stuff out of the black bin and telling them to sort it out,being green wasn't even a thing when i was growing up but i've embraced it.

No, it's a load bollox, SC. The recycling centre only does what Panda does, only Panda collect the shite.

My approach is simple. We have three bins, green, brown and black. On top of the annual fee (€110), the black one costs a small fortune to put out so that isn't used, there's no surcharge for the brown one and the green one has a small weight based surcharge, usually less than €1 per lift. I divide the crap between brown and green based on best fit and I've never had any complaints from Panda.

However, Mrs. Catcher takes a greener approach and will remove stuff from the (internal) green bin that shouldn't be there if she spots it. She tends to squirrel the glass away in another bin out in the back yard and generally takes it to the recycling centre along with any old engine oil and such like periodically. However, I laid a concrete foundation for a shed I started building a few years back this summer so emptied the glass bin under it on that occasion, along with some scrap metal that was lying around. I guess that's "green".

If I'm gonna have to rinse out stuff it should be free.What's the point in wasting water when they're gonna be washed out again at the plant.They make money from the green stuff anyway.
