Court hears taxi driver was being set upon by gang of youths when man stole cash from his wallet


A man who stole cash from a taxi driver's wallet while the driver was set upon by a group of youths has been given a two-year suspended sentence.

Terence Gavin (27) with an address at Moyne Park, Baldoyle, Dublin pleaded guilty at Dublin Circuit Criminal Court to stealing €320 cash from Imram Shahzad at the same address on August 4, 2016.

The court heard today that Gavin was driven home by Mr Shahzad on the night in question and was asked to pay his fare before he called out to a group of teenage boys in a nearby halting site.

The teenagers set upon Mr Shahzad, punching him in the torso and head. One of them threw a stone through the windscreen of the taxi and shattered it.

While this was happening, Gavin took Mr Shahzad's wallet and emptied it of €320 before making off. He was later identified from CCTV footage of the pub Mr Shahzad him picked him up from.

The teenagers have never been identified.

Gavin, who works as a flooring contractor, had €5620 in court for Mr Shahzad as a token of remorse and to cover the money stolen and windscreen damage. He has 12 previous convictions, including for theft, road traffic offences and threatening to cause serious harm.

A victim impact statement by Mr Shahzad was handed in to court, but not read out.

Handing down sentence, Judge Martin Nolan said he must sentence Gavin on the charge of theft before the court and not on the assault. “This man was not responsible for the attack and his wrong-doing was stealing,” he said.

He handed down a two-year sentence and suspended it on a number of conditions, including that Gavin pay over the cash to Mr Shahzad.

Patrick Reynolds BL, defending, accepted the theft was “aggravated by the circumstances” and his client made “a very, very bad mistake” on the night in question. He said he had turned his life around in the intervening years since the theft and was now working and supporting two families.

He said Gavin didn't have a drink or drugs problem, but was drunk on the night in question. “He doesn't have much memory of what happened,” he said.

Fckn CNut was not too drunk to call out to the knackers to assault the driver, knew what he was doing , should have been sent down for this

Good oul Martin Nolan....king of the suspended sentences for filth with multiple convictions....i bet if any of us were up in front of him for knockin the bollox out of a passenger....he'd feel compelled to make an example of us.

no point getting money up front from the knackers, you don't carry them, simple as. is it me or are the foreign drivers being targeted?

I think one thing we have is local knowledge....i've seen foreign drivers stopping for passengers who i wouldn't think twice about driving past...i suppose ignorance is bliss...until the end of the journey when reality dawns.

That doesn't make sense.

there was an article about one of the hutch gang knackers who was jailed for the 30th time there the other day over armed robbery. his wig said to the judge we have to take in to account that he's spent most of his life in jail. so because he's been a scumbag his whole life and continues to be scumbag that merits some sort of leniency. unbelievable bollocks.

Barristers and judges.....all cut from the same cloth,
A judge would think that barrister has the smarts with that defence and a suspended is deffo warranted!!

A young man who admitted the unlawful killing of a father of five at a pub in Mitchelstown walked down the middle of the road in an act of bravado afterwards shouting, 'I am the king of Mitchelstown'.

This was the allegation made by the prosecution as the case opened before Mr Justice Michael Owens and a jury of six men and six women at the Central Criminal Court sitting in Cork today.

Michael Dineen of Ard Mhuileann, Mitchelstown, was arraigned on the charge of murder of 36-year-old Patrick O’Donnell at Willie Andies bar on New Square, Mitchelstown, on June 1. He replied that he was guilty of manslaughter, not guilty of murder.

Defence senior counsel, Brendan Grehan, said at the outset that the accused had made a number of admissions: principally that he was guilty of manslaughter, otherwise referred to as the unlawful killing of Mr O’Donnell.

Mr Grehan said there would be issues related to matters such as intent and provocation.

The defence lawyer also said there were admissions facilitating the prosecution in relation to matters such as accepting that he was properly arrested and detained and similarly that the evidence such as CCTV was properly gathered.

Tim O’Leary, prosecution senior counsel, said he would outline the allegations that the prosecution would be making but he stressed that this was not itself evidence.

He also emphasised the presumption that the accused was not guilty of murder unless determined otherwise by the jury at the end of the trial.

Mr O’Leary said the deceased, a father of five, known by the nickname of 'Ginty', was drinking in the bar from noon that day and the accused was there from later in the afternoon. They were known to each other and not unfriendly.

“Something seemed to happen after around 10pm... An altercation occurred between the two men. What occurs according to the prosecution is that the deceased is pulled down on to the ground by the defendant and a vicious assault takes place,” the prosecution senior counsel said.

"That assault leads to the death of Mr O’Donnell and it happens on the pub floor. There were seven teeth knocked out of Mr O’Donnell, two of which end up in internal parts of his body – one in his thorax, one in his airways. It takes considerable force to knock out someone’s teeth"

Mr O’Leary SC said the assault continued after Mr O’Donnell had become unresponsive and despite efforts by staff and others to break it up.

The prosecution senior counsel said that alleged evidence of intention to cause serious harm was enough to prove intention to murder. But he said it would be for the jury to decide.

The case continues tomorrow.

Not my neck of the woods DMG, Mitchelstown is a 40 minute drive from Cork city.

Every year peoples much loved family pets end up at the fair for sale. This fair attracts over 80.000+ people from the 32 counties, also the UK, Scotland and world over. Orders are put in, vans go out around the 32 counties and family pets are stolen in the blink of an eye. Families work in teams and swap pets over from one county to another. They are then hidden until the fair takes place, many are swapped over, so those stolen in for eg Co cavan can end up in Ballinasloe Co Galway for sale, making it extremely difficult to spot and trace your pets. PLEASE spay and neuter your pets. This makes them less likely to be stolen for breeding purposes and many are often set free when they cannot be used for breeding. Also spay and neutering prolongs their life and prevents many illnesses. PLEASE chip and register your pets. It costs €25+ depending on where you get it done and it gets them reunited with you quickly if they are found at the fair! also in general it's the law and if they wander off you will get them home safe. PLEASE ID tag your dog. Yes ID tags can be removed but it gives them a voice if they wander or break out, it shows someone owns them and gets them home immediately to you safe. Also if you see a photo of dogs /horses etc at the fair that looks like your stolen pet but you are not quite sure, go there and check!!or message someone local to check! because coats are being dyed, markers used, shaved, etc to make obvious definite markings look different. Also if your dog is missing a while even a few weeks they can look completely different from neglect and separation anxiety, lack of care and food. We seen on fb recently where a small pony was stolen from a rescue overnight her beautiful markings scraped off her little face and her hooves painted a different colour and hidden in wooded area in a completely different county. Houses and premises are being watched, have you dogs, what breed,how many, have you horses, livestock, machinery, trailers, people's routines walking their dogs, going to work, if you leave your dogs outside for long periods of time etc PLEASE keep your dogs inside safe, if they are outside make sure you are with them at all times, if you own horses etc make sure they are safe and secure as with all animals. Do NOT leave your pets outside while you are at work or away for any length of time. Please share

Sounds more like a propaganda campaign to get people to spay and neuter.
